The site plan for Park Place, Phase I, Tract I, 1oclud1ng the restaurant, was revlsed and approved by you on November 5, 1984. The developer 1S requestlog a minor plan change to reflect a reconfiguration of the six parking spaces located in the northeast and southeast corners of the southeast parking area and has added tQe nota regarding parking. I recommend you approve the attached revised final slte plan for Park Place, Phase I, Tract I subject to the previous conditlons of approval as follows: 1. Compliance with the Development Order, as amended, and the Annexation Agreement, as amended, appllcable to th1S property. 2. Access shall be prov1ded to the south through M&B 21, 21-1, and 22-1 (~cMullen Property) to State Road 60, w1th the exact locat1on to be determlned at t1me of prel irnl nary Sl te pl an approval for Phase I. Sa1d lngress and egress shall be secured by fee slmple acqu1s1t10n, rlght-of-way easement, or other appropr1ate mechanlsm by e1ther the Developer or the Clty. The Clty agrees to exerC1se such eminent domain powers solely under Chapter 73, Florlda Statutes, 1f necessary, wlth1n twelve (12) months after the effect1ve date of th1S Order, consistent w1th the applicable prOV1s1ons of law, 1n recogn1tion that 1t 1S in the publlC 1nterest tnat such lngress and egress be obta1ned. In tne event that the C1ty so exerC1ses 1tS power of em1nent doma1n to acqu1re rights 1n any of the above reference~ property for lngress and egress. the Developer shall compensate'the City 1n the a~ount of the condemnat1on judgment; except where such Judg~ent exceeds the appralsed value or average of appra1s~d values entered 1nto eVldence in the condemnat1on proceed1ng by the C1ty, the C,ty and the Developer shall, subject to the ~utual consent of the Clty and the Developer as to the reasonableness of the Judgment, share equally (50 percent each) the amount of the Judgment awarded ,n excess of suCh appra1sed value or average values. At the U.S. 19j5.R. 580 and U.S. 19jCountryslde Boulevard 1ntersectlons construct a grade-separated lnterchange. ThlS lmprovement is currently pro- gram~ed in the Plnellas County MPO Transportatlon Improvement Program (constructlon to start 1n FY 1986-87). 2. At the U.S. 19jDrew Street intersection, reassess the eXlstlng green tlme s19nal phaslng. ThlS reassessment is to be done by the Clty wit~1n the 1983-84 work program of the Trafflc Eng1neerlng Department of the Clty. 3. At the U.S. 19jRoosevelt Boulevard lntersectlon, construct a grade-separated 1nterchange. ThlS lmprovement lS currently programmed ln the Plnellas County MPO Transportat1on Improvement Program (con- structlon to start 1n FY 1985-86). 4. Construct access points to Park Place on Hampton Road as needed. Excluslve turn lanes and a traffic slgnal(s) may be needed. The cost of these lmprove- ments shall be the sole respons1b1l1ty of the Developer. Pursuant to subsectlon 4.Z., the Developer shall pay the total cost of these lmprove- ments and the Cl ty shall assume the responsl b, 11 ty for construct1ng these lmprovements. -9- \ 'tli,L 5. At the S.R. 60/Clearwater Mall Drive II intersectlon construct two eastbound to northbound excluslve left turn lanes. The cost of these improvements shall be the sole responslb111ty of the Developer. Pursuant to subsection 4.Z., the Developer shall pay the total cost of these lmprovements and the C1 ty shall assume the responsibllity for constructlng these lmprovements. The City commits that lt 1'1111 let for bld these improve~ents no later than twelve (12) months from the effectlve date of thlS Order with a scheduled construct1on completlon date no later than twenty-four (24) months frolll the effectlve date of thlS Order. 6. Install or renovate, as approprlate, trafflC slgnals at the south project entrance and S.R. 60 and at Hampton Road and S.R. 60. The cost of these lffiprovements shall be the sole responslblllty of the Ueveloper. Pursuant to subsectlon 4.Z., the Developer shall pay the total cost of these 1mprove- ments and the Cl ty shall assume the responsl bl 11 ty for constructlng these i~provements. 7. Construct an exclusive left turn lane on S.R. 60 approach and an addltlonal through lane In each dlrectlon on S.R. 60 at its lntersectlon wlth Hampton Road. Pursuant to subsectlon 4.0. the Developer shall be responslble for the cost of the r1ght-af-way and constructlon of the 1ngress and egress to and from the south through M&B 21, 21-1 and 22-1. ThlS 1ngress and egress wl'l be located so as to maXlmlze the use of Oruld Road V1a Sky Harbor Drlve and Sevllle aoulevard (around the per1meter of the Clearwater Mall). d. Pr10r to the lssuance of the flrst cert1f1cate of occupancy for Phase II, the Developer shall provlde up to $125,000 to the Florlda Department of Transportatlon for the constructlon plans of the U.S. 19jDrew Street grade-separated 1ntcr- change. These funds shall be prov1ded 1n order to obtain a comm1tment for the constructlon of the U.S. 19/Drew Street grade-separated 1nter- change durlng Phase III. 2. At the U.S. 19/5.R. 60 1ntersectlon, construct an eastbound to southbound exclus1ve r1ght turn lane and 1n the edstbound and westbound dlrect10ns construct one add1t1onal exclus1ve left turn lane. Pursuant to subsectlon 4.Z., the Developer shall pay 1tS proportlonate share of the cost for construct1on of thIS lmprovement. -12- G. 3. At the U.S. 19/Bellealr Road lntersection, construct an eastbound to southbound excluslve rlght turn lane. The through lanes shall contlnue to the next lnter- sectlon or some 10g1cal termlnus 1" accordance w1th proper deslgn practlce. Pursuant to sUbs~ctlon 4.Z., the Developer shall pay ltS proport1onate share of the cost for constructlon of these lmprove- ments. 2. At the Belcher Road/Sunset POlnt lntersect1on, construct excluslve rlght turn lanes on all approaches, and construct add1tlonal through lanes in each directlon on Sunset Point Road. The through lanes shall contlnue to the next lntersectlon or some lo91cal termlnus In accordance wlth proper deslgn pract1ce. Pursuant to subsect10n 4.Z., the Jeveloper shall pay 1tS proportlonate share of the cost for construction of these lmprovements. ~ -13- 3. At the Belcher Road/S.R. 60 lntersectlon, construct an addit10nal through lane and addit10nal excluslve left and rlght turn lanes on all approaches. The through lanes shall be cont1nued to the next 1ntersect1on or some 10g1cal termlnus 1n accordance w1th proper deslgn pract1ce. Pursuant to subsect10n 4.Z., the Developer shall pay its proport1onate share of the cost for construct1on of these 1mprove- ments. 4. Constr!.lct add1t1onal access to Park Place on Hampton Road as needed. Exclus1ve turn lanes and a trafflc s1gnal (s) may be needed. The cost of these 1mprove- ments shall be the sole responsl01l1ty of the Developer. Pursuant to subsect10n 4.Z., the Developer shall pay the total cost of these improve- ments and the Clty shall assume the responS10111ty for construct1ng these lmprovements. 5. On McMullen-Booth Road, construct addlt10nal lanes from S.R. 60 to Sunset POlnt Road as 1S currently programmed 1n the Pinellas County MPO Transportatlon Improvement Program (constructlon to start ln FY 1984-85). 6. Install and/or relocate add1t1onal trafflc s1gnals 1n the project area at Drew Street and the north project entrance, Drew Street and HaMpton Road, the two south project entrances and State Road 60, and State Road 60 and Hampton Road. These 1mprovements are to be made 1n phas~s as 1S approprlate, but 1n the1r entlrety by Phase III. The cost of these lmprovements shall be the sole respons1b111ty of the Developer. Pursuant to subsect10n 4.Z., the Oeveloper shall pay the total cost of these 1mprove- ments and the C1 ty shall assume the responsl bll 1 ty for construct1 ng theSe lfilprovements. -14- 7. Expand Hampton Road to a two-lane dlvlded l1nk (two through lanes wlth turnlng lanes as approprlate) from State Road 60 to Drew Street 1n phases related to pOlnts of access on Hampton Road, but In ltS entlrety by Phase III. The cost of thlS lmprovement shall be the sole responslblllty of the Developer. Pursuant to subsectlon 4.Z., the Developer shall pay the total cost of these lmprovements and the Clty shall assume the responslbllity of constructlng the lmprovement. 8. At the U.S. 19/5unset POlnt Road and U.S. 19/ Coachman Road lntersections construct grade separated lnterchanges, provlded, however, such facl11tles shall not remaln a condltlon of approval If TBRPC's transportatlon pollcles are amended or the Developer, at the lnitlatlon of Phase III, agrees to prepare and submit trafflc condltlon lnfor~atlon documentlng that the lmprovements are no longer necessary to mlt1gate reglondl lmpacts. H. The Clty further agrees to the followlng: 1. In the lnterest of recognlZlng the commltments toward road lmprovements made by the Developer and to provlde for the treatment of other developments In a comparable fashlon, the Clty wlll reVlew and evaluate potentlal approprlate leglslatlon deal1ng wlth local transportatlon lmpact fees, 2. The Clty wl'l cooperate wlth and expedlte, where posslble, the deslgn of all FOOT lmprove~ents WhlCh are necesSltated in part by Park Place, In partlc- ular the U.S. 19/Drew Street grade-separated lntercnange, 3. The Clty wlll support as a hlgh prlorlty the earl} schedullng and constructlon of a grade-sepdrdted J.S. 19/0rew Street lnterchange; and -15- 4. The C1ty wl11 revlew and recommend as 15 appropr1dte the redeslgnat10n of the U.S. 19/5.R. 60 area, lncludlng Park Place, as a reglonal activlty center under the TBRPC Regional Plan. I. The developer shall, durlng construct1on of Phase I of the ProJect, prepare a Transportatlon System ~anagement (TSM) Plan, which shall be submitted for approval COlnCldent with the submittal of the prellm1nary S1te plan for Phase II of Park Place. The TSM Plan shall be submltted to the Clty, the TBRPC, the P1nellas County MPO, FOOT and the Plnellas Suncoast Transit Author1ty, as appropriate. The plan of TSM ~easures as approved by the Clty shall be lnst1tuted dur1ng Phase II of the Project and implemented for the durat10n of the l1fe of the Project, accordlng to the follow1ng: 1. Conceptual Development Plan. IMmedlately following the effectuatlon of the annexatlon of the Annexed Property, the Cl ty shall 1ssue lts Development Order relat1ve to the Project Property. B-2. , . 4. Parkland Dedication. The City's parkland dedlcatlon requlrement shall be satlsf1ed in full upon the payment by the Developer to an independent trustee deslgnated by the C,ty of the sum of $600,000.00, such payment to be made wlthin flve (5) days followlng the effectlve date of the Development Order. ThlS sum shall be lnvested in an interest bearlng account as dlrected by the City wlth the interest to accrue to the beneflt of the City. The developer shall exerClse lts best efforts for a period of twelve (12) months from the effectlve date of the Development Order, to locate and acquire, upon terms Mutually acceptable to the Developer and the Clty, a recreatlonal facllity acceptable to the Clty 1n the Clty's sole dlscretlon. In the event that Developer lS successful ln contractIng for the acqulsltlon of such a faci11ty, then the Clty shall authorlze the trustee to dlsburse so much of the funds held by 1t as May be necessary to close the acqulsitlon contracted for by the Developer for conveyance to the Clty. The balance of the funds held by the trustee, 1f any, shall be pald over to the Clty. The Clty may, ln ltS sole d1scretlon, choose to assume any mortgages that may encumber such a fac1l Ity, or contrlbute toward the purchase prlce of such a facl11ty, or both. At any tlme prior to the Developer contractlng for acqulsl- tlon of such a facllity upon Wrltten notlf1catlon by the Clty to the Developer and the trustee, the trustee shall promptly pay over to the Clty the funds, lncludlng lnterest, held by It. Land Use Deslgnat10n and Zonlng. If Developer constructs roads on the ProJect Property in general conformance wlth the deslgn shown on Exhlbit "0'1 of the Development Order and In locations and to speclflcatlons acceptable to the Clty, then City shall accept any such road dedicated by Developer to the public or the Clty. Access Easement. The Clty agrees not to prevent the rlght of lngress and egress to the out parcels frontlng on State Road 60 provlded that a maXlmum of two (2) pOlnts of lngress and egress to State Road 60 shall be permltted east of the maln project entryway and a maXlmum of two (2) pOlnts of lngress and egress to State ~oad 60 shall be perm1tted west of the maln project entry. 3 - 6. The partles further recognlze that there may be no adequate remedy at law for any such breach.
