Upon due cons1derat1on, w~th each party having had the advice and aSS1stance of separate counsel whose signatures appear below, it is STIPULATED AND AGREED AS FOLLOWS. 1. DEESTAR, as owner of the commercial business center known as Hill Crest Center and as grantee of that certain ingress/egress easement described in the Plaintiff's Complaint and running along the northern border of Plaintiff'S condominium property shall replace the damaged chain-11nk fence wh1ch presently exists and runs the approx1mate length of the SUbJect easement median. DEESTAR shall replace sa1d chaln-l1nk fence with a six-foot high wooden prlvacy fence purchas~d and installed at the expense of DEESTAR. 2. The above-referred existing chain-link fence shall be removed by and at the Plalntlff' s expense, 3 The subject easement's median and curblng thereto presently running the length of the median shall remaIn unchanged. . ,~ / / 4. Traff~c from U. S. 19 into the H~ll Crest Center side of the road at the median intersection wi th U. S. 19 shall be entry traff~c only. Traffic d~rectIon along that north side of the easement adJacent to Hill Crest Center shall be one-way only and shall be in an east to west directIon and traffic direction along the Center's eastern driveway adJacent to Melons Restaurant, DEESTAR's tenant, shall be one-way only and shall be in a south to north d~rection In an effort to control traffic as described herein, DEESTAR w~ll take the following action at its own expense: (a) DEESTAR will place a standard traffIc sign readIng "ONE WAY - 00 NOT ENTER" at the north/northwest end of the easement driveway facing north so as to prevent traffic from enterIng the northwest end of the easement from Hill Crest Center. (b) DEESTAR will place a standard traffic sign reading "ONE WAY - DO NOT ENTER" at the northern end of the east driveway which runs parallel to U. S. 19 between Melons Restaurant and U. S. 19 so as to prevent traffic from traveling south along said driveway and onto the subject easement (c) DEESTAR will place a standard traffic sign reading "ONE WAY ONLY" at the eastern end of the easement on Hill Crest Center's property to direct traffIc entering HIll Crest Center from U.S 19 along the Hill Crest Center s~de of the easement in an east-to-west directIon only. (d) DEESTAR will place a "NO DELIVERY" sign at the rear door of Melons Restaurant to alleviate the problem of traffic backing up along the easement. 5. In add~tion to the actions outlined above under Paragraph 4, DEESTAR shall make a good faith effort to notify tenants at Hill Crest Center that parking of trucks and other commercial vehicles on the subiect easement 18 prohibited during delIveries of goods to such tenants. Furthermore, DEEST~R shall make good faith efforts to require tenants at H~ll Crest Center to prevent the drainage of sewage from sewage/grease receptacles associdted WIth any and all of the bUSIness operations of ~ts tenants (including but not limited to the tenants operat~ng restaurants -2- and/or liquor lounges at Hill Crest Center), from draining onto the Plaintiff's condominium property. 6 In the event that there is a reoccurrence or continuation of sewage drainage onto condomin~um property as described above, or if there is a continuat~on of Hill Crest Center patron traffic failing to obey the directional signs or of parking of delivery trucks on the easement, HILL CREST shall not be barred from further litigation related to these two matters by virtue of res jUdicata, collateral estoppel, or estoppel by judgment. 7, DEESTAR w~ll provide a copy of this fully executed St~pulat~on for Settlement, along w~th a s~te plan (prepared by DEESTAR at its expense) to Keith Crawford, Director of Traffic Engineering for the City of Clearwater. Said site plan shall show the placement of the wooden pr1vacy fence and the specific traffic signs. This agreement for settlement shall be contingent upon approval of the site plan by Keith Crawford, D~rector of Traff~c Engineering for the City of Clearwater. 8, DEESTAR w~ll bear the expenses of any and all permits which are requ1red by the City of Clearwater with respect to the above fence and traffic signs. 9. Each party shall be responsible for ~ts fees and costs in th~s action. 10. The site plan, along with a copy of this Stipulation for Settlement, shall be submitted by DEESTAR to Keith Crawford as descr~bed above, within th1rty (30) days of the date of this settlement. Upon approval of the site plan from Keith Crawford, DEESTAR shall have a period of thirty (30) days for completion of the fence and traffic sign installation. These time periods may be mod~fied by the parties pursuant to wr1tten instrument only. 11. It is agreed by the partioA that the terms of this Stipulat~on for Settlement shall be b~nd~ng upon DEESTAR's assigns, successors ~n ~nterest and in title to the real property known as Hill Crest Center, together with the ingress and egress easement to sa~d real property, all of which is described ~n that certain warranty deed recorded in P1nellas County Official Records -3- --- Book 6423, Pages 1883 and 1884, on February 9, 1987, a copy of wh~ch is attached hereto and incorporated herein by reference. McDonald's At Hercules and Sunset pt RD (PSP 96-03): The DRC approved the site plan subject to the following conditions /discussion: A. Before the site Plan can be certified, the applicant must complete the following action(s): 1. Provide a draft cross-access easementj agreement linking the MC Donald's site to the northern portion of lot 1 including wordlng only one access to the Northern portion of lot 1 will have only one access to Hercules Avenue. 2. Provide a reference on the site plan that a cross-access easement agreement will apply noting how it will affect the two sites. 3. Note on the site plan that the only access allowed onto Hercules Avenue will be the one through Lot 1. 4. Pay the required Open space and Recreation Assessment Fee with review by the Clearwater Parks and Recreation Department. S. Show pavement striping in the Hercules entrance to control traffic entering the site to the satisfaction of the Traffic Engineer. 6. Remove the triangle with the Keep Right sign from the southern site entrance. 7. Apply for an administrative lot subdivlsion with the property owner's disclosure included. B. Before the city can issue building permits, the applicant must complete the following actions: 1. Obtain and furnish evidence of all applicable permits from other governmental agencies including but not limited to: (a)pinellas County permit for work within the Right-of- Way to Engineering Services; (b)SWFWMD permit to Clearwater Environmental Management; (c}Pinellas County Public Health unit Permit, u Ingress/Egress and a 10 foot ut11ity Easement over the proposed water mains up to and including meters, backflow prevention devices and hydrants. 2. Pay the sewer impact assessment fee, based on the size of the water meter with assistance in determining the fee from Central Permitting/Licensing specialists. 3. Acquire clearing and grubbing and tree removal permits or a no tree verification form from Environmental Management. 4. Show the existing 5 ft. easement along the full length of the west side of the property. 5. Relocate the storm pipe and inlet outside of the 10 ft. utility easement along the south side of the site. 6. Design and show the force main from the 11ft station as a minimum of 3 inches in diameter with deta11 shown on the plans for the tie in to the city sewer system. 7. Design and show the water line across Hercules as a 6 inch ductile iron line in a casing. NOTE: condition Cl, below, requires an approved administrative lot subdivision within 15 days after the issuance of building permits. Failure to provide such administrative lot subdivision will result in the suspension of any building permits issued. C. Before the city can issue a Certificate of Occupancy, the applicant must complete the following actions: 1. Provide an executed copy of the an adrninistrati ve lot subdivision not later than 15 days after the issue of building permits noting that failure to provide such document will result in the voiding of such building permits issued. 2. Bring all substandard sidewalks and sidewalk ramps adjacent to or a part of the project up to standard, including ADA, and install sidewalk where none exists in the street right of way. 3. Visually screen the dumpster and provide gates with a minimum 22-foot clear opening to the front and to the re- cycling container for access by Solid Waste vehicles. 4. Furnish as-builts and an eng1neer's cert1f1cation to Engineering services. 5. Pay the Transportation Impact Fee as called for by the Pinellas County Transportation Impact Fee Ordinance with assistance 1n determining the fee from the Clearwater Traffic Engineering Off1ce. 6. Direct lighting from parking lot luminaries and other sources downward and away from residential areas. 7. Furnish a copy of the recorded cross-access agreement to the Zoning section in Central Permitting. D. Complete the following actions as indicated: 1. Obtain the requisite building permits within one(!) 2 o year from the site plan certification date to prevent expiration of the site plan certification. 2. Obtain the requisite certificate(s) of occupancy within three (3) years of the site plan certification date to prevent expiration of the site plan certification. 3. Obtain review of and permits for signs and fencingj walls through separate review and permi~ting procedures. II. Computer city (PSP 96-02): The ORC approved the site plan subject to the following conditions jdiscussion: A. Before the site Plan can be certified, the applioant must complete the following action(s): 1.Identify and distinguish between the new and existing buildings and driveways as well as other features on the plan. 2. Show the date(s) and condition(s) for approval of variance(s) /conditional use approvals by the Planning & Zoning &/or the Development Code Adjustment Board(s). 3.0btain a Significant Change of Use Determination from the FOOT per Florida Statute 335. 4. Provide a copy of the SWFMWD permit application and calculations to Environmental Management. 5. Be aware that the project is exempt from the city's Open Space and Recreation Assessment Fees. 6. Obtain FOOT approval for any change in access to site. 7. Re-design the on-site stormwater dralnage system to the satisfaction of the City utility engineer to balance the system between the southern and northern branches to prevent overloading the southern portion. B. Before the city can issue building permits, the applicant must complete the following actions: 1. Obtain and furnish evidence of all appllcable permits from other governmental agencles lncludlng but not llmlted to: FDOT permlt for work withln the Rlght-of-Way to Englneerlng Services. 2.
