PERPETUAL EASEMENT
THIS EASEMENT made this 0'-^' day of ,Ud VC-1440.e,r2019, by the City of CLEARWATER ,
a municipality of the State of Florida, grantor, to the STATE OF FLORIDA DEPARTMENT OF
TRANSPORTATION, 11201 N. McKinley Dr. Tampa, F1 33612, its successors and assigns, grantee.
WITNESSETH: That the grantor for and in consideration of the sum of One Dollar and
other valuable considerations paid, the receipt and sufficiency of which is hereby
acknowledged, hereby grants unto the grantee, its successors and assigns, a perpetual
easement for the purpose of constructing and maintaining a PEDESTRIAN OVERPASS in, over,
under, upon and through the following described land in PINELLAS County, Florida, viz:
A parcel of land lying in the NE 1/4 of Section 19, Township 29 South, Range 16 East,
Pinellas County, Florida, being more particularly described as follows:
Commence at a 1/2" iron rod and cap stamped "LB 2168", said point also being the East One
Quarter (1/4) corner of said Section 19, thence along the east -west center line of said
Section 19, N 89°29'26" W, a distance of 100.00 feet to a point on the West Right of Way line
of State Road 55 (U.S. Highway 19) (a 200 foot Right of Way per Florida State Road Department
Right of Way Map Section 1515-104); thence along said West Right of Way line of State Road
55, N 00°52'04" E, a distance of 260.14 feet to a point on the South Right of Way line of
Harn Boulevard, as described in Official Records Book 2582, Page 417, of the Public Records
of Pinellas County, Florida, and the POINT OF BEGINNING; thence departing said West Right of
Way line of State Road 55 along the South Right of Way line of Harn Boulevard, N 89°32'21" W,
a distance of 183.86 feet; thence departing said South Right of Way line of Harn Boulevard,
N 00°52'04" E, a distance of 21.45 feet; thence S 89°32'21" E, a distance of 30.48 feet;
thence N 00°52'04" E, a distance of 8.17 feet; thence S 89°32'21" E, a distance of 20.42

RESOLUTION NO. 19-
A RESOLUTION OF THE CITY OF CLEARWATER, FLORIDA GRANTING TWO
PERPETUAL EASEMENTS IN FAVOR OF THE FLORIDA DEPARTMENT OF
TRANSPORTATION FOR THE PURPOSE OF CONSTRUCTING AND MAINTAINING A
PEDESTRIAN OVERPASS AT HORN BOULEVARD AND U.S. 19 NORTH, CLEARWATER,
FLORIDA; PROVIDING AN EFFECTIVE DATE.
WEE MS, the State of Florida Department of Transportation proposes to constructor
improve State Road No. 55, Section No. 15150-XXXX , in PINELLAS County, Florida; and
WBERRAB, it is necessary that two easements across certain lands now owned by THE CITY
OF CLEARWATER, Florida, be acquired by the State of Florida Department of Transportation; and
WBERRAB, said use is in the best interest of the City; and
MAMMAS, the State of Florida Department of Transportation has made application to said
City to execute and deliver to the State of Florida Department of Transportation two
perpetual easements in favor of the State of Florida Department of Transportation for the
purpose of constructing and maintaining a PEDESTRIAN OVERPASS, and said request having been
duly considered; now therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CLEARWATER FLORIDA:
Section 1. The application of the State of Florida Department of Transportation for
two perpetual easements are for transportation purposes which are in the public or community
interest and for public welfare; that two perpetual easements in favor of the State of
Florida Department of Transportation in the City of CLEARWATER , Florida, should be drawn
and executed by this City Council. Consideration shall be TEN DOLLARS and XX/100 ($10.00).
The City Council of the City of Clearwater hereby grants two perpetual easements,
copies of which are attached hereto and incorporated herein as Exhibits "A" and "B• to
Resolution 19 -
Section 2. A certified copy of this Resolution be forwarded forthwith to the State of
Florida Department of Transportation at 11201 N. Malcolm McKinley Drive Tampa, Florida 33612.
Section 3. This resolution shall take effect immediately upon adoption.
