WHEREAS, 'James Lively .and Mildred N. Lively (jointly., "Grantor"), .s: husband and
wife.. .granted and.conveyed to the .City of Clearwater, Florida,. an easement .over, underand
across- certain land lying and being situate in the County. of Pinellas, State of Florida„fer the
installation andmaintenance of a natural .gas line; and
WHEREAS, thesuccessor in interest to Grantor ("Successor") has requested that the.
casement be tertninated and released; 'and
WHEREAS, the CitydoesnOt have, gas facilities withinthe. easement and does not.need
the easement forthe.ptirposes intended.

2. Termination and Release of Easement. The City hereby terminates, releases and
relinquishes all -easement -and other rights created in that certain Easenient dated

across that certain laid as more particularly described in Exhibit" A", attached hereto
and incorporated herein).
3. Binding Effect. The covenants contained in this Easement Termination and Release
are not personal but shall run with the land and shall be binding upon and inure to 'the
benefit of'the feesimple titleholder ofthe Property, and their respective heirs;
personal representatives, transferees,, successors or assigns..
