96-10� RESOLUTION NO 96-10 � A RESOLUTION OF THE CITY OF CLEARW�;TER, FLORIDA, FINDING TWE PROPOSED SHOR6LiNE PROYECYIOIV CONS3RUCTION PROJECT ASSOCIATED WITW �F9E G6tAlUD@ �AY �4PARTMENT COM9PLEX TO BE A PUBLtC NECESSITY WITH MITIGATION REQUIRED; PROVIDIIVG AN EFFECTIVE DATE. WHEREAS, the City of Clearwater Comprehensive Plan contains Po�icy 1.1.1, which states: "Any permanent and temporary alteration of' Department of Environmental Regulation (D.E.R.) jurisdictional or nonyurisdictional wetlands, beach dunes, or other above-mentioned natural systems shali oniy be permitted upon a finding by the City Commission of public neaessity, and upon consideration of mitigation."; and WHEREAS, a shoreline protection construction project is proposed in a wetland area adjoining the Grande Bay Apartment complex; and WHEREAS, the State of Florida Depactment of Environmental Protection has issued a permit authorizinA certain permanent construction in the wetland' area adjoining the Grande Bay Apartment complex with mitigation reguired; and WHEREAS, the City of C�earwater Environmental Manaeement Group/Engineering Department has reviewed the Grande Bay shoreline protection construction project and the State of Florida Department of Environmental Protection permit authorizing such construction, and finds that the proposed project is of public necessity due to Yhe erosion occurring at this location that is undermining utilities and resulting in the loss of property and mitigaYion is needed for acceptable environmental protection so long as certain minor amendments to the project/permit are made; and VI/HEREAS, the City Commission accepts the finding of its staff that the project is of public necessity with mitigation required; now therefure, • BE IT RESOLVED BY THE CITY COMMISSIOfV OF THE CITY OF CLEARWATER, FLORIDA: Section 1. The Grande Bay Apartment shoreline protection const�ruction project, as modified in accordance with City ofi Glearwater Environmental Management Group/Engineering Department requirements, is a public necessity and mitigation is required; Section 2.
