95-59_,13 BMO DRAFT #2 06/27/95 #2518 RESOLUTION NO. 95 -59 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA, ESTABLISHING THE DATE, TIME AND PLACE OF A PUBLIC HEARING AT WHICH PROPERTY OWNERS AND OTHER INTERESTED PERSONS MAY BE HEARD WITH RESPECT TO THE BURYING OF FLORIDA POWER CORPORATION POWER LINES ALONG GULF BOULEVARD ON SAND KEY INCLUDING THE PROVISION OF DECORATIVE STREET LIGHTING, AND THE COST THEREOF, THE MANNER OF PAYMENT THEREFOR, AND THE AMOUNT TO BE ASSESSED AGAINST EACH PROPERTY BENEFITTED BY THE IMPROVEMENTS; ACCEPTING A PRELIMINARY ASSESSMENT ROLL FOR THE PROJECT; PROVIDING FOR NOTICE TO BENEFITTED PROPERTY OWNERS. WHEREAS, the City commission has proposed to have Florida Power Corporation's power lines buried along Gulf Boulevard on Sand Key, and the existing wooden street light support poles replaced with durable concrete or fiberglass poles, as described more specifically in Resolution 95 -58; and WHEREAS, a preliminary assessment roll for the project has been prepared, and it is necessary to publish the preliminary assessment roll and to conduct an equalization hearing before the roll may be finally adopted; now, therefore, NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. The City Commission shall conduct a public hearing as required by section 27.05, Code of Ordinances of the City, in the City Commission Chambers, third floor of City Hall, 112 South Osceola Avenue, Clearwater, Florida, on September 7, 1995, beginning at 6:00 p.m. or as soon thereafter as the matter can be heard. At that time, the owners of property to be assessed and other interested persons may appear and be heard as to the propriety and advisability of making such improvements, as to the cost thereof, as to the manner of payment therefor, and as to the amount thereof to be assessed against each property. Section 2. The City Commission shall conduct a public hearing as required by section 197.3632(3), Florida Statutes, in the City Commission Chambers, third floor of City Hall, 112 South Osceola Avenue, Clearwater, Florida, on September 7, 1995, beginning at 6:00 p.m. or as soon thereafter as the matter can be heard. At that time, the City will consider adopting a resolution stating the intent of the City to use the uniform method of collection as provided by section 197.3632, Florida Statutes, to collect the special assessment considered in section 1 above. Owners of property to be assessed and other interested persons may appear and be heard as to the propriety and advisability of utilizing such method of collection. Section 3. The City Clerk shall give notice of the special assessment public hearing by mail (not less than 20 days prior to the hearing elate) to each benefitted property owner and shall cause notice of the time and place of the public hearing to be published twice (with the first publication not less than 20 days prior to the hearing date) in a newspaper of general circulation in the City of Clearwater, as provided in Section 27.05, Code of Ordinances of the City, and as required by section 197.3632, Florida Statutes, regarding use of uniform method of collection of non -ad valorem assessments. Section 4. The City Clerk shall also publish for 4 consecutive weeks notice of the public hearing regarding the use by the City of the uniform method of collection of the special assessment as required by section 197.3632(3), Florida Statutes.
