A RESOLUTION OF THE CITY OF CLEARWATER, FLORIDA,
PROVIDING FOR A REFERENDUM TO GRANT AUTHORITY TO GIVE AD
VALOREM TAX EXEMPTIONS SHOULD AN ENTERPRISE ZONE BE
APPROVED; PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
WHEREAS, the Department of Economic Development has requested the
Clearwater City Commission to authorize the creation of an enterprise zone
pursuant to F.S. Chapter 290, the boundaries of which may include census blocks
groups: 258 -2, 258 -3, 259.01 -2, 259.02 -2, 259.02 -3, 259.02 -6, 261 -2, 261 -3,
261 -6, 262 -1. 262 -2, 263 -7. 264 -1, and 268.08 -02, but will not include any other
areas of the City of Clearwater.
AND WHEREAS, an enterprise zone as created by the City Commission, is
subject to approval by the State of Florida,
AND WHEREAS, Florida Statute 196.1995, Section 3, permits the governing
authority of a municipality to call for a referendum within its jurisdiction to
determine whether to grant economic development ad valorem tax exemptions
pursuant to Article VII, Section 3, of the State Constitution, for enterprise
zones.
AND WHEREAS, local municipalities are permitted to call for such referendum
authority prior to the creation of the enterprise zone, pending approval by the
State of Florida.
BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF CLEARWATER, FLORIDA:
Section 1. The following question in substantially the form required by
Florida Statute §196.1995(3) shall be placed upon the ballot at the March 14,
1995 general election and referendum election:
AD VALOREM TAX EXEMPTION FOR ENTERPRISE ZONE
Shall the City Commission of the City of Clearwater be authorized to
grant, pursuant to s. 3, Art. VII of the State Constitution,
property tax exemptions for new businesses and expansions of
existing businesses which are located in an enterprise zone?
Yes - -For authority to grant exemptions.
No - -- Against authority to grant exemptions.
Section 2. The City Clerk is directed to notify the Pinellas County
Supervisor of Elections that the referendum item provided above shall be
considered at the election to be held on March 14, 1995.
_Section 3. This resolution shall take effect immediately upon adoption.
