94-57 (2)RESOLUTION NO. 94 -57 A RESOLUTION OF THE CITY OF CLEARWATER, FLORIDA, ESTABLISHING FEES FOR PAYMENT IN LIEU OF PROVIDING REQUIRED PARKING FOR DEVELOPMENT PROJECTS IN THE URBAN CENTER (BAYFRONT), URBAN CENTER (CORE) AND URBAN CENTER (EASTERN CORRIDOR) ZONING DISTRICTS; ESTABLISHING SPECIFIC USES FOR FEES SO COLLECTED; AUTHORIZING THE CITY ENGINEER TO DETERMINE THE AMOUNT OF SUCH FEES AND TO COLLECT SAID FEES; AUTHORIZING THE EXPENDITURE OF SAID FEES AS PART OF THE CITY'S CAPITAL IMPROVEMENT PROGRAM; REPEALING ANY PREVIOUS RESOLUTION ON THE SAME SUBJECT; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Clearwater recognizes the need for flexible parking standards to accommodate and promote development and redevelopment projects in the Urban Center (Bayfront), Urban Center (Core) and Urban Center (Eastern Corridor) zoning districts; and WHEREAS, the City's Land Development Code makes provisions for payment in lieu of providing required off - street parking and for establishing the responsible department for receiving and administering these fees in accordance with City Code Section 40.488(4)(e); now, therefore, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section L. In accordance with City Code Section 40.488(4)(e), the fee for payment in lieu of providing required off - street parking shall be $4,500.00 per space. Section 2. Any use of the fees collected shall be limited to parking improvements in the Urban Center (Bayfront), Urban Center (Core) and Urban Center (Eastern Corridor) zoning districts, and the timing, type and location of said improvements shall be at the exclusive discretion of the City of Clearwater. Fees shall be limited to only those improvements that add to the supply of public parking in the applicable zoning districts, not to maintenance costs associated with existing or newly established public parking or to parking improvements outside the applicable zoning districts. Section 3. The City Engineer shall be authorized to determine the amount of the fees in accordance with the provisions of this resolution and to establish a fund for the placement of the fees so collected. Use of the fees for specific projects shall be governed through the City's Capital Improvement Program. Section 4. This resolution shall take effect immediately upon adoption.
