A RESOLUTION OF THE CITY OF CLEARWATER, FLORIDA, RELATING TO THE USE
OF A PORTION OF CITY -OWNED PROPERTY KNOWN AS FRANK TACK PARK,
PREVIOUSLY DEDICATED AS ADDITIONAL RIGHT -OF -WAY FOR SUNSET POINT
ROAD (COUNTY ROAD 576) ; AUTHORIZING THE CONVEYANCE TO PINELLAS
COUNTY OF A TEMPORARY RIGHT OF ENTRY OVER A PORTION OF THE PARK
PROPERTY LOCATED NORTH OF AND ADJOINING THE ADDITIONAL RIGHT -OF -WAY;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Commission by adopting Resolution 91 -37 on September 19,
1991, . dedicated a portion of Frank Tack Park as additional right -of -way for
Sunset Point Road, and authorized the conveyance to Pinellas County of a
temporary right of entry over adjoining City -owned property described herein; and
WHEREAS, the temporary right of entry expired on December 31, 1992, and it
is necessary and proper to authorize the conveyance of a new temporary right of
entry as provided herein; now, therefore,
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. In order to facilitate improvements by Pinellas County to
Sunset Point Road (County Road 576), the City Manager is authorized to execute
on behalf of the City of Clearwater a temporary right of entry to Pinellas County
to allow the construction by the County of a temporary staked silt fence over
that portion of Frank Tack Park described and depicted in Exhibit A to this
resolution. Said right of entry shall expire upon completion of the road
widening project or 24 months from the effective date of this resolution,
whichever occurs first.
Section 2. This resolution shall take effect immediately upon adoption.
PASSED AND ADOPTED this 5th day of May 1994.
