A RESOLUTION OF THE CITY OF CLEARWATER, FLORIDA,
DESIGNATING A TRACT OF LAND LOCATED WITHIN THE
INTERSECTION OF CLEARWATER PASS AVENUE AND SOUTH
GULFVIEW BOULEVARD, DESIGNATED AS A "PARK" ON THE PLAT
OF BAYSIDE SHORES SUBDIVISION, AS PUBLIC ROAD RIGHT -OF-
WAY; PROVIDING AN EFFECTIVE DATE.
WHEREAS, a small triangular (approximately) parcel of property located
within the intersection of Clearwater Pass Avenue, sometimes referred to as Gulf
Boulevard, and South Gulfview Boulevard on Clearwater Beach is shown on the plat
of Bayside Shores Subdivision, according to the plat thereof recorded at Plat
Book 58, Pages 11 and 12, of the public records of Pinellas County, Florida; and
WHEREAS, said parcel was designated as a "park" on the plat of Bayside
Shores Subdivision and was dedicated to the public along with "roads, streets,
easement and public places" by the owner and subdivider, but the parcel consists
of approximately 1,000 square feet (more or less) surrounded on all sides by
public road right -of -way and paved road surfacing, and has never been used for
any purpose except as a median in the roadway; and
WHEREAS, the proposed plans for improvement to the intersection include a
median of approximately the same size and shape, at approximately the same
location; and
WHEREAS, the parcel is not usable as a "park" due to its small size,
irregular shape, lack of a safe pedestrian access, lack of parking, and the heavy
volume of motor vehicular traffic on all sides of the parcel at all hours of the
day and night, and is suitable for no other practical use except as a median or
otherwise as part of the public road right -of -way; and
WHEREAS, the parcel has no national, state, or local historical
significance whatsoever and
WHEREAS, the Florida Department of Transportation has questioned whether
the parcel may be a "significant" public park, recreation area, or wildlife and
waterfowl refuge or a "significant" historic site, within the meaning of Section
4(f) of the Department of Transportation Act of 1966, in conjunction with the
Department's review of the Clearwater Pass Bridge Replacement Project (State
Project No. 15140- 3518); and
WHEREAS, the parcel cannot reasonably be deemed to be a "significant"
public park, recreation area, or wildlife and waterfowl refuge or a "significant"
historic site due to its size, shape, location, and actual uses; now, therefore,
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. The City Commission does hereby designate the tract of land
within the intersection of Clearwater Pass Avenue and South Gulfview Boulevard,
designated as a "park" on the plat of Bayside Shores Subdivision, as public road

Section 2. This resolution shall take effect immediately upon adoption.
Section 3. Upon adoption of this resolution, a certified copy shall be
provided by the City Clerk to the Public Works Director to be delivered to the
Florida Department of Transportation in as part of the City's documentation for
the Clearwater Pass Bridge Replacement Project (State Project No. 15140- 3518).
