92-53RESOLUTION No. 92 -53 A RESOLUTION OF THE CITY OF CLEARWATER, FLORIDA, ASSESSING CERTAIN REAL PROPERTY LOCATED IN IRA E. NICHOLSON'S SUBDIVISION, HAVING A POST OFFICE ADDRESS OF 703 NICHOLSON STREET, CLEARWATER, FLORIDA, AS DESCRIBED MORE PARTICULARLY HEREIN, IN THE AMOUNT OF $1,890.00 FOR THE COSTS OF DEMOLITION INCURRED IN REMOVING A DANGEROUS STRUCTURE, WITH THE CONSENT OF OWNER. WHEREAS, pursuant to Chapter 138 of the Clearwater Code of ordinances and the Standard Building Code, the Building official determined that certain real property described herein and the buildings situated thereon were unsafe, unsanitary, unfit for human habitation, and dangerous and detrimental to the health, safety, and general welfare of the community, and did not properly comply with the requirements of said Code, and found that an emergency existed which, in his opinion, involved imminent danger to human life and health, and ordered the demolition of the building; and WHEREAS, the owner of the property signed a Waiver of Notice and Hearing, requesting the City of Clearwater to demolish such structure and for the City of Clearwater to file a lien against the property for the cost of demolition; and WHEREAS, the City of Clearwater has caused the demolition of the building, and the cost of such work should now be assessed as a lien on behalf of the City of Clearwater against the property; now, therefore, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. The Building official having ordered the demolition of the building situated on the following described property: Ira E. Nicholson's Addition to Clearwater, Florida, Block 1, Lot 13, Parcel #09/29/15/60102 /001/0130. Owner of record: Salathiel Gaiter (Deceased) Margaret Gaiter Brown, (Wife of deceased owner) 2782 Robinwood Drive Clearwater, Florida 34619 -1505 and the City of Clearwater having now completed said work, the City Commission does hereby assess and charge a lien on behalf of the City of Clearwater against the property for the necessary costs incurred as follows: Demolition Cost $1,890.00 /,� ` Section 2. As soon as practicable, a Certificate of Indebtedness against the property for the amount of assessment shall be prepared, which certificate shall constitute a lien prior to all other liens except the lien for taxes. Said certificate, when issued, shall be payable to the City in not exceeding ten (10) equal annual installments with interest at a rate not greater than eight percent (8 %) per annum. Section 3. The City Clerk is hereby directed to prepare a Notice of Lien in the amount of the assessment against said property, and to record the same in the Public Records of Pinellas County, Florida.
