92-40M_ RESOLUTION NO. 92 -40 A RESOLUTION OF THE CITY OF CLEARWATER, FLORIDA, OPPOSING A PROPOSED AMENDMENT TO THE PINELLAS COUNTY CHARTER WHICH WOULD GIVE PRECEDENCE TO COUNTY ORDINANCES IN CONFLICT WITH MUNICIPAL ORDINANCES; PROVIDING AN EFFECTIVE DATE. WHEREAS, Section 2.01 of the Pinellas County charter provides that when there is a conflict between a county ordinance and a municipal ordinance, the municipal ordinance shall prevail; and WHEREAS, the preservation of local self - government was a key provision in the cities' support of the adoption of the county charter in 1980; and WHEREAS, each of the 24 cities within Pinellas County has adopted regulations, standards and priorities which contribute to each city's unique character and sense of community; and WHEREAS, each city has been granted "home rule" authority under the Florida Constitution and the laws of the State of Florida; and WHEREAS, the proposed county charter amendment would restrict or eliminate the "home rule" authority of every city in Pinellas County; now, therefore, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. The City Commission of the City of Clearwater hereby declares its opposition to the proposed Pinellas County charter amendment which would give precedence to county ordinances in conflict with local municipal ordinances.
