A RESOLUTION OF THE CITY OF CLEARWATER, FLORIDA,
AUTHORIZING THE CONVEYANCE TO THE STATE OF FLORIDA
DEPARTMENT OF TRANSPORTATION OF A TEMPORARY
CONSTRUCTION EASEMENT ON CITY PROPERTY, CURRENTLY
LEASED TO CHI CHI RODRIGUEZ FOUNDATION, FOR THE
RECONSTRUCTION OF AN EXISTING POND RELATING TO THE
STATE ROAD 580 CONSTRUCTION PROJECT; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the State of Florida, Department of Transportation (herein the
"DOT "), proposes to construct or improve State Road No. 580, Section No.
15070 -2525, in Pinellas County, Florida; and
WHEREAS, it is necessary that certain lands now owned by the City of
Clearwater, Florida, be used temporarily by the DOT; and
WHEREAS, said use is in the best interest of the City; and
WHEREAS, the DOT has made application to the City to execute and deliver
to DOT a temporary easement in favor of the DOT for the purpose of
reconstruction of an existing pond; now, therefore,
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. The application of the DOT for a temporary easement is for
transportation purposes which are in the public or community interest and for
public welfare, and the execution of the temporary easement in favor of the
DOT (a copy of which is attached hereto as Exhibit A) is hereby approved. The
consideration for this easement is $1.00.
Section 2. A certified copy of this resolution shall be forwarded
forthwith to the State of Florida Department of Transportation in Tallahassee,
Florida.
Section 3. This resolution shall take effect immediately upon adoption.
