RESOLUTION NO. 92 -22
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF CLEARWATER, FLORIDA ESTABLISHING A
SECOND DEFERRED COMPENSATION PLAN, APPOINTING
THE U.S. CONFERENCE OF MAYORS AS PLAN
ADMINISTRATOR FOR SUCH PLAN, AND DESIGNATING
THE CITY MANAGER OR HIS DESIGNEE TO ACT AS
COORDINATOR FOR THE PROGRAM.
WHEREAS, the City of Clearwater has previously established a
deferred compensation plan for its employees; and
WHEREAS, to provide more flexibility in their choice of
plans, the City desires to establish a second deferred
compensation plan for its employees; and
WHEREAS, the U.S. Conference of Mayors has established a
deferred compensation program for cities, permitting its member
cities and their employees to enjoy the advantages of this
program; and
WHEREAS, the U.S. Conference of Mayors, as Plan
Administrator, agrees to hold harmless and indemnify the City,
its appointed and elected officers and participating employees
from any loss resulting from the U.S. Conference of Mayors or its
Agents failure to perform its duties and services pursuant to The
U.S. Conference of Mayors Program; now therefore
BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF CLEARWATER, FLORIDA:
Section 1. That the City Commission hereby authorize
participation by the City of Clearwater in the U.S. Conference of
Mayors Deferred Compensation Program.
Section 2. That the City Manager of the City of Clearwater,
or such other responsible City official who shall be designated
by the City Manager for this purpose, is hereby authorized to
execute for the City, individual participation agreements with
each said employee requesting same, and to act as the
"coordinator" of the Plan representing the City, and to execute
such agreements and contracts as are necessary to implement the
Program.
