RESOLUTION NO. 91 -39

A RESOLUTION OF THE CITY OF CLEARWATER, FLORIDA,
AMENDING RESOLUTION 79 -7, WHICH DEDICATED CERTAIN CITY -
OWNED PROPERTY ABUTTING CLEARWATER BAY FOR PUBLIC PARK
AND OPEN SPACE USE, TO CORRECT THE LEGAL DESCRIPTION OF
THE PROPERTY; PROVIDING A RETROACTIVE EFFECTIVE DATE.
WHEREAS, the City of Clearwater dedicated certain City -owned property for
public park and open space use by adopting Resolution 79 -7 on February 1, 1979,
but a portion of the property described in the resolution was not owned by the
City at that time, and the City Commission finds it necessary and appropriate to
correct the record and establish that it was not the intention of the City to
assert ownership rights over property not owned by the City; now, therefore,
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. Section 1 of Resolution 79 -7 is amended to read:
1. That the following described City- owned property is
hereby dedicated for public park and open space use for the use and
benefit of the citizens of the City of Clearwater, Florida:
Sunset Court and vacated Sunset Court right -of -way and
Lots 2 and 3 of Rompon' s & Bask i n' s Corrected Map of
Causeway Business District Subdivision as recorded in
Plat Book 57, page 1 of the Public Records of Pinellas
County, Florida, less the right -of -way of Drew Street,.
and less that portion of Lot 2 of said Subdivision which
was excluded from the conveyance to the City of
Clearwater according to the Indenture dated June 13,
1960, and recorded at Official Records Book 927, page 9,_
of the Public Records of Pinellas County, Florida.
Section 2. The City Clerk is hereby directed to record this resolution in
the public records of Pinellas County, Florida.
Section 3. This resolution shall take effect retroactively to February 1,
1979, the date of adoption of Resolution 79 -7.
