AN ORDINANCE OF THE CITY OF CLEARWATER,
FLORIDA, RELATING TO DISHONORED CHECKS,
DRAFTS AND MONEY ORDERS, AMENDING
SECTION 2.528, CODE OF ORDINANCES, TO
IMPOSE A SERVICE FEE OF TWENTY DOLLARS
($20.00) OR FIVE PERCENT OF THE FACE
AMOUNT, WHICHEVER IS GREATER, FOR THE
COLLECTION OF A DISHONORED CHECK, DRAFT
OR MONEY ORDER; PROVIDING AN EFFECTIVE
DATE.

THE CITY OF CLEARWATER, FLORIDA:

aestion 1. Section 2.528, Code of Ordinances, is amended to read:
Sec. 2.528. Dishonored check, service fee.
(a) Any person who presents a check, draft or any other form of order
to the City for the payment of money, which check, draft or order is subsequently
dishonored, shall be subject to a service fee of $20.00 or five percent of the face
amount of the check, draft or order, whichever is greater, for the collection of the
dishonored check, draft or order.
(b) Notice to any person subject to the provisions of this section that a
check, draft or order presented to the city has been dishonored shall be similar to
that set out in Section 832.07(1), Florida Statutes.
Section 2. This ordinance shall take effect immediately upon adoption.
