THIS INDENTURE made this ~....J. day of ~ ' 1994,
by and between the city of Clearwater, Fda, a Florida Municipal
Corporation, party of the first part, and the Florida Department of
Transportation, of the state of Florida, party of the second part, whose
mailing address is 11201 North McKinley Drive, Tampa, Florida 33612-6403.
WITNESSETH: That the party of the first part, for and in consideration
of the sum of Ten Dollars ($10.00) and other good and valuable
considerations, including, but not limited to, any required right-of-way
clearing and utility relocations, to it in hand paid by said party of the
second part, at or before the ensealing and delivery of these presents, the
receipt whereof is hereby acknowledged, has granted, bargained, sold,
conveyed and confirmed unto the said party of the second part, and to its
heirs and assigns forever, all the following piece, parcel, lot or tract of
land, situate, lying and being in the County of Pinellas and state of
Florida, and described as follows, to wit:

Lying within the following described boundary, to-wit:

1/4 of Section 17, Township 29 South, Range 16 East, Pinellas County,
Florida, run thence North 89056'49" West, a distance of 2,689.93 feet along
the North boundary of the Northwest 1/4 of said section 17 to the Northwest
corner thereof; thence South 01003'38" West, a distance of 1,191.56 fe.et
along the West boundary of the Northwest 1/4 of said Section 17; thence South
88056'22" East, a distance of 139.19 feet to the Easterly right-of-way line
of U.S. #19, D.O.T Section 15150-2512 and the POINT OF BEGINNING; thence
North 13055'39" West, a distance of 54.91 feet along said Easterly right-of-
way line; thence North 89053'49" East, a distance of 14.66 feet to a point on
a curve; thence Southerly, 53.34 feet along the arc of a curve to the right,
having a radius of 7,649.44 feet and a central angle of 00023'58" (chord
bearing South 01033'11" West, 53..34 feet) to the POINT OF BEGINNING.

TOGETHER WITH all and singular the tenements, hereditaments and
appurtenances thereunto belonging or appertaining; and every right, title or
interest, legal or equitable, of the said party of the first part, of in and
to the same.
TO HAVE AND TO HOLD the same unto the said party of the second part, its
heirs and assigns, to its own proper use, benefit and behoof forever.
IN WITNESS WHEREOF, the said party of the first part has caused these
presents to be executed in its name by its City Manager, City Clerk,
countersigned by its Mayor-Commissioner, and approved as to form and
correctness by its Office of City Attorney, and its corporate seal to be
hereunto attached, the day and year first above written.
