BEFORE ME, the undersigned authority, personally appeared GEORGE R.
SMOYER, JR., and being first duly sworn, says:
1. I am the son of George R. Smoyer, who during his lifetime purchased the
south one half of Block 3, Lot 4, of the Clearwater Cemetery, consisting of eight
burial plots.
2. My father has predeceased me, and I am his sole surviving heir.
3. As the sole surviving heir of my father, I am entitled to the above-
described property in the Clearwater Cemetery.
4. This Affidavit is executed in order to induce the City of Clearwater,
Florida, to accept a conveyance of the above-described property from the estate of
my father and to reconvey the above-described property to myself and my wife,
Marjorie L. Smoyer, jointly.
5. As an additional inducement, I promised to defend, indemnify and hold the
City of Clearwater harmless in the event of any claim against the City of Clearwater
of any nature whatsoever resulting from the conveyance and reconveyance of the
property as described above. This obligation shall be binding upon my heirs, successors
and assigns.
