CONTRACT FOR CEMETERY SPACE
THIS CONTRACT, Made and entered into this 14th day of May
1982 , by and between the CITY OF CLEARWATER, FLORIDA, a municipa~'
corporation, party of the first part, hereinafter referred to as "CITY",
and
Peggy H. Osteen
whose address is:

party of the second part, hereinafter referred to as IIPURCHASER";
- WITNESSETH: That in consideration of the mutual promises and cove-
nants herein contained, and other valuable considerations passed between
the parties hereto, the City agrees to sell and the Purchaser agrees to
-buy the following described space or spaces, as the case may be, in
Clearwater Cemetery, more particularly described as follows:

BALANCE OF: $154.90
PAYABLE AT THE RATE OF $25.81 (5 payments, 1 at $25.85) Dollars,
six (6)
in ~W€~~~~~~0-~~ua2-monthly installments commencing with the first
installment one month from date of execution and a like sum each month
thereafter until the entire principal amount has been paid in full.

In the event of default in any monthly installment, the entire sum
shall be immediately accelerated entitling City of Clearwater to demand
said sum in full, and failure of the purchaser to make said payment shall
entitle the City to retain all proceeds theretofore paid, as liquidated
damages.
NO SPACE SHALL BE USED AS A BURIAL SITE UNTIL SA~lli HAS BEEN PAID FOR IN
FULL.
The time of payment shall be of the essence hereof, and upon default
in payment of any part of the purchase money, as and when the same
becomes due, the City may rescind this contract, retaining the cash
consideration paid therefor, and may also retain title to any part or
portion of said property which has not been used for grave space, and
thereupon this contract shall become null and void.
THE PURCHASER FURTHER AGREES to abide by any rules or regulations
governing the use and maintenance of space in Clearwater Cemetery
Addition as said rules now exist or may be made in the future. This
contract shall not be assigned nor shall any grave space sold hereunder
be transferred without the written consent of the City of Clearwater.
The obligations and benefits under this contract shall extend to
the personal representatives and heirs of the Purchaser and the
successors of the City.

Dear Mrs. Osteen:
There has been a great deal of confusion on the contract
for the above space in the Clearwater Cemetery. We must have
the original and ail the copies of the contract you have to
establish one legal binding contract. If you return the
necessary papers we will be happy to send you a copy of the
contract when it has been completed and signed by the appro-
priate authorities.
Your July payment due on the 14th has not been received
and unless we receive the July and August payments and all
the necessary papers by August 14, 1932, we shall refund the
monies you have paid less an administrative charge and close
our records on this contract.
Please advise Dorothy at 462-6684 of your intentions in
this matter.
