Dear Mrs. O'Connor:
Thank you for providing me with the copy of your birth certificate
and your statement to the effect that you are the sole surviving
heir of Beatrice Morgan, which I am delivering to the City Clerk
for her files.
Based upon the information you have provided us, I am of the
opinion that you are the owner of the three unused spaces. Asthe
owner, your rights include the right to sell any unused spaces back
to the City or to another. If you sell the spaces to another, the
city Clerk would like to be informed of that fact.
Should you have any further questions regarding this matter, please
let me know.

Dear Mrs. O'Connor:
Your letter of August 7, 1990, and the copy of the letter from
Judge Charles T. Carlton dated October 31, 1983, have been
forwarded to me by the City Clerk for review in connection with
your request for clarification of your rights as owner of the three
unused spaces in Lot 63, Clearwater Cemetery.
The letter from Judge Carlton relates to oil and gas rights in
Colorado and is not evidence of ownership of the cemetery spaces.
However, there exists on the spaces a marble marker with your name
as well as the names of Beatrice Morgan, Virginia Mendenhall, and
victor J. Morgan, which is pretty convincing evidence of ownership
of at least one of the spaces.
Our city cemetery records from the 1940's are pretty sketchy. When
we receive requests for confirmation of ownership of spaces in the
cemetery, we often must ask for help in documenting the ownership
of the spaces. In your case, I would consider a certified copy of
your birth certificate, a certified copy of the will of Beatrice
Morgan (if any) naming you as heir, and a sworn statement to the
effect that you are the sole surviving heir of Beatrice Morgan, as
sufficient evidence for our purposes. A copy of the cemetery de~d
would be nice to have, but is probably too much to ask for.

Our records indicate that Victor H. Morgan and the cremated remains of Beatrice
Morgan are interred in Space 4. A marble marker is on Space 4 for Victor Morgan.
A upright marble marker is centered on spaces 1, 2, and 3 with an inscription
for Beatrice Morgan at the top and inscriptions for Virginia Mendenhall, Victor
J. Morgan and Victoria O'Connor. Even though no burials have been made in those
spaces, placement of the triple marker would indicate that Space 3 has been
reserved for you.
