I understand I will not receive any monies which I have paid. ~e~\ 2~~~oL Randy Fitzpatrick p ~. , r/' ~vj (J v ~ INSTALLMENT CONTRACT FOR CEMETERY SPACE THIS CONTRACT made and entered into this 2nd day of February, 1994, by and between the CITY OF CLEARWATER, FLORIDA, a municipal corporation, hereinafter referred to as "CITY", and NAME: Randy Fitzpatrick ADDRESS: 1229 Nicholson Street Clearwater, FL 34615 of the County of Pinellas, state of Florida, hereinafter referred to as "PURCHASER" ; WITNESSETH: That in consideration of the mutual promises and covenants herein contained, and other valuable considerations, the City agrees tc sell and the Purchaser agrees to buy; the following described space, in Clearwater Cemetery, as follows: Space 3, Lot 76, Block 15, as recorded in Plat Book 60, Page 30, Public Records of Pinellas County, Florida. PURCHASE PRICE is $500.00 $50.00 $450.00 DEPOSIT: BALANCE DUE: PAYABLE in five (5) monthly installments of $75.00 each, commencing with the first installment due on March 1, 1994 and each month thereafter with the final payment of of $89.00 to include recording fee. The unpaid balance may be prepaid at anytime without penalty. A cemetery deed for the space shall be issued to Purchaser upon payment of the balance due. In the event of default in any monthly installment, the entire sum may be immediately declared due in full, and failure of the purchaser to make said payment shall entitle the City to retain all proceeds theretofore paid, as liquidated damages, and thereupon this contract shall become null and void. NO SPACE SHALL BE USED AS A BURIAL SITE UNTIL THE BALANCE HAS BEEN PAID IN FULL. THE PURCHASER FURTHER AGREES to abide by all rules and regulations governing the use and maintenance of space in Clearwater Cemetery. This contract shall not be assigned nor shall any grave space sold hereunder be transferred with the written consent of the City of Clearwater. The obligation and benefits under this contract shall extend to the personal representatives and heirs of the Purchaser and the successors of the City.
