CONTRACT FOR CEMETERY SPACE
THIS CONTRACT, Made and entered into this 1st day ofFebruarv
1982 , by and between the CITY OF CLEARWATER, FLORIDA, a municipa~'
corporation, party of the first part, hereinafter referred to as "CITY",
and
Gustav and Gladys Bjerkenes
whose address is:
634 Bellevue Boulevard, Clearwater, FL 33516
of the County of Pinellas , State of Florida
party of the second part, hereinafter referred to as "PURCHASERI!;
WITNESSETH: That in consideration of the mutual promises and cove-
nants herein contained, and other valuable considerations passed between
the parties hereto, the City agrees to sell and the Purchaser agrees to
-buy the following described space or spaces, as the case may be, in
Clearwater Cemetery, more particularly described as follows:

Public Records of Pinellas County, Florida, which space or spaces shall
be used for not more than 2 burial sites or graves.
THE TOTAL PURCHASE PRICE of said property shall be the sum of:
$200.00
payable at the times and in the manner following:
CASH PAID AT TI~lli OF EXECUTION OF THIS CONTRACT $40.00
BALANCE OF: $160.00
PAYABLE AT THE RATE OF Thirteen and 35/100 ($13.35)
Dollars,
in twelve (12) equal monthly installments commencing with the first
installment one month from date of execution and a like sum each month
thereafter until the entire principal amount has been paid in full.
In the event of default in any. monthly installment, the entire sum
shall be immediately accelerated entitling City of Clearwater to demand
said sum in full, and failure of the purchaser to make said payment shall
entitle the City to retain all proceeds theretofore paid, as liquidated
damages.
NO SPACE SHALL BE USED AS A BURIAL SITE UNTIL SAblli HAS BEEN PAID FOR IN
FULL.
The time of payment shall be of the essence hereof, and upon default
in payment of any part of the purchase money, as and when the same
becomes due, the City may rescind this contract, retaining the cash
consideration paid therefor, and may also retain title to any part or
portion of said property which has not been used for grave space, and
thereupon this contract shall become null and void.
THE PURCHASER FURTHER AGREES to abide by any rules or regulations
governing the use and maintenance of space in Clearwater Cemetery
Addition as said rules now exist or may be made in the future. This
contract shall not be assigned nor shall any grave space sold hereunder
be transferred without the written consent of the City of Clearwater.
The obligations and benefits under this contract shall extend to
the personal representatives and heirs of the Purchaser and the
successors of the City.
