WHEREAS, the City C'o i ssion established the Equity Study
,-ommissioni to review the occupational license fees and
ordinances;
WHEREAS , the Equity Study Commission has reviewed the
ordinances: and fees and made recommendations for change while
providingan. equitable occupational license fee schedule and
ordinance; now therefore
BE IT, ORDAINED BY THE CITY COMMISSION OF THE
CITY OF CLEAR WATER, FLORIDA:
Section 1 . Section 29 -21 is amended to read:
Sec. 29 .21. _�Leq-tificates or examinations reca1ired. Spere:-
No occupational license shall be issued[ to ally
person otherwise required by ordinance of the city to have a
certificate of competency or to have passed an examination before
engaging in a business or profession in the city, until such person
has exhibited to the city, man, er proof of having the certificate or

Section 4 . Section 29 .26 is amended to read:
Sec:. 29 .26. Enforcement and inspection--Generally.
(1) The following persons are authorized to conduct'
inspections in the manner prescribed in this section:
(a) The city manager shall make all_ investigations reasonably
necessary for the enforcement of this code a -t- �.
(b) The city manager shall have the authority to order the
inspection of licensees, their businesses record';
s sue, by any a4-1- city officials having duties to
perform with reference to such licensees or businesses .
(c) All -police officers shall be empowered to enforce
compliance with the provisions of this article.
(2) All ;personas authorized in this section to inspect
licenses, e-L- businesses or records —ham the authority to
enter', with or without search warrant as the law may require, at
all reasonable times, the following premises:
(a) Those for which a license is required;

(b) Those for which a. license was issued and which, at the
time of inspection, are operating under such license;
(C) Whose for which a. license has been revoked; or suspended.
Section 5 . Section, 29 .27 is hereby repealed.

Section '6 . Section 29 .28 is amended to read;
Sec. 29 .29 . Determination of classifications.
If there is a disagreement between the applicant and city
staff on the question of proper classification for any business,
occupation or profession for license purposes, the city manager
shall decide � ae proper classif '.cation, .but the apps icant has the
right to appeal leis � decision to the city commission,
whose decision shall be final. .
Section 'G ., Section 29 .30 is amended to read:
Sec. 29 .30. Lie—ease required.
(2) Any � person who maintains a permanent business locution

for obtaining a city oc.c°upational license.
(3) Any person who does not maintain a permanent business
location or branch office within the city but who desires to
transact a ;w. Ibusiness or within engage In. any, 1

With the city manager the license of that municipality or other
governmental subdivision in which they he-dees maintain a permanent
business location, unless otherwise provided by this article. Such
registration sha'Ill be accomplished prior to the commencement of the
business;, shall be subject to a registration fee as prescribed in
appendix. A to this Code and shall be valid from the < date, of
issuance to the next succeeding October 'I .
,4) The burden of securing an occupational license rests with
the principal of a business, but in the event of noncompliance by
the principal, his agent or employee shall be subject to the .dame
enforcement policies.
(5) - For pro erties with multiple businesses , an occupatic nal
license `shall be �reguired for each business.

Sec. 29.30. License squired.
(1) No person who maintains gal permanent business location or
branch office within the city shall engage in or manage a
profession, business or occupation named in this article within the
city, unless a city license shell be issued to such person,• on
receipt of the amount stated in this article. Such license shall be
signed :by the finance director and shall have the city .seal
affixed.
Section 9 . Section 29 . 31 is amended to read:
Sec. 29 .31. Issuau=e requirements for new businesses.

44+ Within 30 days of the submittal of an application, the
director of central. permitting shall issue a license or notify the
applicant in writing setting forth the grounds for the city?s

refusal to issue a, license. The applicant shall have the right of
appeal as specified in section 29 .44 .
Section 10. Section 29 . 32 is amended to read:
Sec. 29 .32 . Sia gle license certificate for more than one license.
"n all cases where the same person or corporation must obtain
more than one license for the business operated at the same
location, that person or corporation may be issued a single license

certificate describing the various licenses represented by such
certificate, 1'.n such a case the amount paid for the 'license shall
be the same. as if individual certificates are issued. This
section shall serve only to permit the city to consolidate the
separate liceases into one certificate.
Section 11 . Section 2`9 .34 is amended to read:
Sed. 29..34 Applicability to certain professions.
The ,mg ,, red tax pr-�ed in section 29 .88 for architects,
auctlGneers, auditors accountants, attorneys, dent gists;,.
draftsmen, emgI eers, chiropractors, physicians, real estate
brokers and' sales associates , and other similar professions
shall be consltirued to mean that each individual` person I shahl pay
the talc provided, for in this article whether practicing by himself,
employed b:V another, or in a partnership, corporati6n or ,
professional association, except where the professional services of
a particular, en2ployee are wholly utilized by the employer and are
not available to the public,' either privately or, in the name of the
employer.
Section 121 . Section 29 .37 is amended to read:
Sec,. 29.37 ' IdWitification on tracks required.
Any and al.l trucks or other vehicles' operated or used in
connection with any contracting, building, delivery, maintenance,
repair' service, or manufacturing business or occupation conducted
within the city shall have painted or otherwise prominently
displayed in a visible and legible manner upon such truck or other
vehicles, the naxie and address of the business in which such truck
or other vehicle is used. Fe _ --tien, Seuch
information .shall be painted on both sides of the vehicle and the
letters in such sign shall be a minimum height of three inches.
Section 13 .. Section 29 .38 is amended to read:

Licenses issued by the city may be transferred with the
approval of the director of central permitting, subject, however,
to the following conditions:
(,a) All business licenses may be transferred to a new owner
when {there is a bona fide sale of the business upon
paymtent of a transfer fee as prescribed in appendix A to
this Code and presentation of evidence of the sale and
the crigi:nal license.
(b) Upon written request and presentation of the original'

(c) Where the licensee has been exempted from payment of all
or any peat of the license tax therefor, any such license
shall not be transferable pursuant to this section
(d) Holders of alcoholic beverage licenses shall comply with
chapter 6 of this code.

of the business, must be lawful under

Sec. 29 .39. Review; upon renewal:-.
(1) Upon the annual renewal of all licenses, any license may
be reviewed a4-iA" .' to determine if all applicable provisions
of this article, states county,city laws ordinances,
rules and regulations have been complied with, ----- kh�

Section 3-5 ., Section 29 . 40 is amended to read:
Sec. 29 .40. Delinquent penalties.
(1 11 All license taxes imposed by this article shall be dire and
payable on October 1 of each year and shall expire on September 30
of the succeeding bear. Those licenses not renewed by October 1
shall be considered delinquent and shall be subject to an

It is the duty of the code
enforcement officer or a law enforcement officer to make affidavit
of violation and request for hearing; and to cause such person or
persons or officers and directors of any corporation to be brought
before the Municipal Code Enforcement Board or the county court .

Section. 17.- Section. 2S? .50 is amended to read.
Sec® 29 .50. Debt to the city.
The amount of any license tax, fee and penalty imposed by the
provisions of this article is hereby declared to be a debt clue to
the city, and any person carrying on any business without first'
hawing' procured a license from the city to do so shall be liable to
the city for the amount of such license tax, administrative fee and
penalty recoverable in any court of competent jurisdiction.

Sec. 29 ..52 » Payment of fees prerequisite to issuance of license.
It is the inn nt of the city to grant valid occupational
licenses only to those applicants who have fully and faithfully
paid the required fees as established in the schedule of fees in
A. end in this code te=a-? ?. No license shall be valid until
all fees are so paid. A d-shoncred bank draft, check or other
similar x3on.cia h pavment shall be in direct contravention of _.he
intent expressed sed in this section. Any occupational license :issued
to any appli ant whose payment is subsequently dishonored shall be
void ab initio-.
Section <24 . Section 29 . 58 is hereby repealed.
Section 21. Appendix A of the City Code of Ordinances shall
be amended to include the Occupational License Tax Fee Schedule as
set forth in E'Xhibit A attached to the original of this ordinance.
Section :22. This ordinance shall take effect on QctokCer 1,
1995.
