EASEMENT
FOR AND IN CONSIDERATION of the sum of One Dollar ($1. 00) cash
in hand paid to it, the receipt of which is hereby acknowledged, and the
benefits to be derived therefrom, U. S. HOME OF FLORIDA, INC. , a
Florida corporation, does hereby grant and convey to the CITY OF
CLEARWATER, FLORIDA, a municipal corporation, an easement over,
under and across the following described land, lying and being situate
in the County of Pinellas, State of Florida, to wit:

This easement being for utilities installation and maintenance,
including water well sites, water lines and electrical feeder lines.

The CITY OF CLEARWATER, FLORIDA, shall have the right to
'enter upon the above-described premises and to construct, install and
maintain thereon any utility lines and facilities, including water well
sites, water lines and electrical feeder lines, and to inspect and alter
such utilities from time to time.
That any damage done by the CITY OF CLEARWATER, FLORIDA to the existing
facilities of U. S. HOME OF FLORIDA, INC. (including but not necessarily limited
to pavement, undergrOlmd sprinkler system pipes, sprinkler heads, underground
water supply pipe, underground telephone circuit, underground electrical
conduit) shall be promptly repaired or restored by the CITY OF CLEARWATER, FLORIDA
to a condition equal to or better than the original condition of said existing
facilities.
That the, CITY OF CLEARWATER, FLORIDA agrees, by acceptance hereof, that
nothing herein contained or contemplated shall, at any time increase U. S.
HOME OF FLORIDA, INCls risk or liability for any personal injury or death
or for any property damage, and the CITY OF CLEARWATER, FLORIDA expressly agrees
that U. S. HOME OF FLORIDA, INC. shall not assume any such additional risk or
1iabili ty . By acceptance hereof, the CTY OF CLEARWATER, FLORIDA further agrees
that so long as it exercises any of the rights herein granted, it shall hold
harmless and indemnify U. S. HOME OF FLORIDA, INC. for any and all loss or
damage to property of U. S. HOME OF FLORIDA, INC. and for injuries to or death
of persons lawfully upon and within said Easement Area, resulting by reason of
the construction, presence, operation and/or maintenance of the CITY OF CLEARWATER's
facilities within said Easement Area, and which loss or damage arises or is
occasioned from the default or negligence of the CITY OF CLEARWATER in the
exercise of the duties or rights and privileges provided for in this easement.
IN WITNESS WHEREOF, the party hereto has caused these presents
to be duly executed by its proper officers thereunto authorized and its seal
to be hereunto affixed, this 19th day of September , 1974.
