5823-95 ORD I FIANCE ., 5823-95 AN ORDINANCE OF THE CITY OF CLEARWAI:ER, FLORIDA RELATING TO THE LAND DEVELOPMENT CODE: AMEND114G SECTIONS 44.05, 44.51, AND 44,55, CODE OF ORDINANCE-S, TO REGULATE NEON AND OTHER FORS OF EXPOSED SIGNS OR LIGHTING; PROS IDING3 AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEA.RW,KrER, FLORIDA: Section 1. Section 44.05, Cede of Ordinances, is amended to read. 44-.05. DeflniitiOns. All words used in these regulations, except where specifically defi fined in this section, shall carry their customary meaning when not inconsistent with the context in which they are used. Nonconformi ng sign means any sign that does not conform to the requi r ments of this chapter. Section 2. Section 44. I:, Code of Ordinances, is amended to read: Sec. 44.51, Pe i t:ed signs: sign standards. (1) Purpose. It is the intent of this section to regulate signs by sign type. Permits are required for these signs. The requirements of this section are in addition to all other applicable requirements of this chapter. In the e�irent of a conflict between the requirements of this section and other appll i cabl e regdi r es tints, the more stringent requirements shall govern. (2) Sign standards, general rules. Nothing in this chapter sha111 be construed to prevent or limit the display of legal notices, warnings, informational , traffic, or other such signs which are legally required or necessary for the essential functions of governrinentall agencies. Section S, Section 44.55, Code of Ordinances, is amended to read .55. Nonconforming signs. ( ) Any sign which is in v i el ati on of Crdi nance No. 4035 or Grdi rare Nom 4753 but which is rendered conforming in all resp cts by Ordinance No. 5257 shall be considered to have been brought into compliance with this chapter, and any pending citation or notice to appear befdre the unicipal code enf6rcemert board r the county court shall be dismissed.
