Thank you for attending the neighborhood meeting that was held at
my office a few weeks ago, and taking the time to make me aware
of your community concerns.
All of the neighbors spoke loud and clear. I understand that
there are great concerns with the plan that was presented.
I listened closely to your concerns, and I have decided to
substantially change the plan that was proposed.
I am now asking you to consider to allow parking of vehicles only
in the area that it was once occurring, completely behind the two
h'ouses I own on Rogers street, where the fence now exists. I am
not anymore proposing,to create newer parking, nor removing any
home structure, nor any changes beyond the currentlytexisting
fence line.
with these changes in mind, and in consideration of the interest
shown from the attendance of the community, I would like to take
this opportunity to invite you to another meeting at my office,
1433 Court Street,.on the evening of March 22nd at 6:30 P.M., in
order to present this newly proposed plan to you, and to receive
feed back from you to modify or change what is proposed. If you
are unable to attend, please call my office so that we can select
another day or time.

The purpose of this communication is to confirm the elements that are necessary for Dr. McDowell to
come into compliance with the code, to meet the pending deadline by the Code Enforcement Board.
Please be aware that Dr. McDowell currently intends to address the elements listed in the pending
code enforcement citation, while pursuing a site plan and flex to allow the situation to exist.
Implicit in the October 18th Notice of Hearing letter issued to McDowell Holding Co., Inc., is a
listing of the exact items necessary to come into compliance. I have checked with Marc Parry and the
sprinkler system does not have to be an in- ground, PVC piping. This list will be the exact items that
are proposed to be rectified by Dr. McDowell to be into compliance to meet the order of the Code
Enforcement Board. If there are any other items, please make me aware of them immediately.
Scott Kurleman will be notified immediately when the items are finished to ensure that the site meets
compliance. Please be assured that Northside Engineering, Housch Ghovaee and myself, are working
closely with the Doctor, to ensure that a credible and comfortable solution is reached for the site.

The Municipal Code Enforcement Board has heard testimony at its regular meeting held on
January 24, 2001, and based on the evidence issued its Findings of Fact, Conclusions of Law,
and Order as follows:
FINDINGS OF FACT
After hearing testimony of Code Inspector Scott Kurleman, (the Respondent was not
present and had no representation), and viewing the evidence, City Exhibits 1 -9 (Ex. 1 — notice
of violation; Ex. 2 — property appraiser printout; Ex. 3 — code reference; Ex. 4 — affidavit of
violation and request for hearing; Ex. 5 — notice of hearing; Ex. 6 — photos; Ex. 7 — petition from
surrounding residents; Ex. 8 — application for site plan approval; and Ex. 9 — site
plan /landscaping plan dated 1/12/94), it is evident the property is in violation of Section(s) 3 -1204
(A), (B), (F), (1), & (L) of the Code in that a required landscape buffer has been removed and cars
are being parked on this area.
CONCLUSIONS OF LAW
The Respondent by reason of the foregoing is in violation of Section(s) 3 -1204 (A), (B), (F),
(1), & (L) of the Code of the City of Clearwater, Florida, in that the Respondent has failed to
remedy the cited violation(s).
ORDER
It is the Order of the Board that the Respondent is to correct the aforesaid violation by
February 17, 2001. The burden shall rest upon the Respondent to request a reinspection by the
Code Inspector to verify compliance with this Order.
In the event the aforesaid violation is found, in subsequent proceedings by this Board, not
to have been corrected on or before February 17, 2001, the Respondent may be ordered to pay a
fine in the amount of two hundred fifty and no /100 dollars ($250.00) per day for each day the
violation continues beyond February 17, 2001.
If Respondent does not comply within the time specified, a certified copy of the Order
imposing the fine may be recorded in the Public Records of Pinellas County, Florida, and once
Found in Violation
recorded shall constitute a lien against any real or personal property owned by the Respondent
pursuant to Chapter 162 of the Florida Statutes.
Any aggrieved party may petition the Board to reconsider or rehear any Board Order
resulting from a public hearing. A petition for rehearing must be made in writing and filed with
the Board Secretary no later than thirty days after the execution of the Order and prior to the
filing of any appeal. Upon receipt of the petition, the Board will consider whether or not to
reconsider or rehear the case. The Board will not hear oral argument or evidence in determining
whether to grant the petition to reconsider or rehear.

FACTS BEHIND THE VIOLATION:
The above referenced individual/business removed a required landscape buffer and is parking many cars on the
lawn area. This parking is occurring on a parcel zoned for residential. The parcel of land in the rear of the
subject property was purchased, fence moved to the south, landscape buffer on the subject property removed and
parking on the residential lot. An attempt be CRT was made in February of 2000 to bring the site into
compliance. These parking spaces were not and can be approved by Traffic Engineering. Replace the entire south
buffer which was removed. This buffer must be 10' wide and adjacent to the paved parking lot per the approved
plan submitted in May 1995. The buffer must contain 2 shade trees, 27 shrubs, and an automatic irrigation system.
No parking is permitted in approved landscape areas. Replace missing/ declining shrubs in west buffer. This site
remains in violation.

It has been brought to our attention that the houses at 1430 and
1432 Rogers Street were to be torn down to make way for a parking lot.
This would appear to be an infringement on the residents with property
in the area, namely Rogers Street, because of the noise and distractions
it would create.
We oppose the parkin, lot entirely. If it does happen however, we
would need a 50 to 80 ft buffer zone on Rogers Street, for the property
owners comfort.
Please give this matter your immediate attention so we can keep the
pleasant, quiet neighborhood that we all enjoy.

public hearing before the Municipal Code Enforcement Board in the Commission Chambers, 3rd floor, City
Hall at 112 South Osceola Avenue, Clearwater, Florida, concerning a violation of Section(s) 3 -1204 (A),
(B), (F), (1), & (L) of the Clearwater City Code of Ordinances. (See attached Affidavit of Violation).
You are hereby ordered to appear before the Municipal Code Enforcement Board on that date to answer
these charges and to present your side of the case. Failure to appear may result in the Board proceeding
in your absence. Should you desire, you have the right to obtain an attorney, at your own expense, to
represent you before the Board. You will also have the opportunity to present witnesses as well as
question the witnesses against you prior to the Board making a determination. Please be prepared to
present evidence at this meeting concerning the amount of time necessary to correct the alleged
violation, should you be found to be in violation of the City Code.
If the violation described in the attached Affidavit of Violation is corrected prior to the hearing scheduled
but recurs prior to the scheduled hearing date, the hearing will still be held as scheduled.
Should you be found in violation of the City Code, the Municipal Code Enforcement Board has the power
by law to levy fines of up to $250 a day against you and your property for every day that violation
continues beyond the date set in an order of the Board for compliance.
If you wish to have any witnesses subpoenaed, please contact the Secretary of the Municipal Code
Enforcement Board within five (5) days at 727 - 562 -4090. If you have any questions regarding the cited
violation, please contact the Inspector whose name appears on the Affidavit of Violation.

Dear Scott Kurleman,
On December 11*' I observed a city of Clearwater employee with a camera, so
stepped out to have a word with him. After talking with him for a few moments an
overwhelming need to protect our two -block street came over me.
First of all I have been a Clearwater resident in the same house for over 51 years. As
you can imagine I do not want it changed. Enclosed is petitioned signed by every resident
living on Rogers Street who agree.
Secondly, we the people of Rogers Street, object the current code violation; the
incorrect parking on the Rogers Street area. If the city were to allow parking on Rogers
Street property this could set possible precedent for other business from Court street to
infringe on Rogers Street.
In addition, we understand that the McDowell application has been rejected because it
was incomplete. We also request that a public chance be held, so that we the residence of
Rogers Street can be heard. Please keep us informed of the status of this situation. We
would appreciate any up dates to know that our efforts are paying off.
Finally, We as a neighborhood resist this action of 1400 and 1432 and will take the
necessary steps to keep Rogers Street from changing. This is a family oriented area and
we would like to keep the commercialized areas left to major streets not our
neighborhood.

Neighbors on Rogers Street
On December 11, 2000, I met by chance a City of
Clearwater employee who was taking pictures of two of
the houses across the street from my home. These
houses are 1430 and 1432 Rogers Street. I asked what
was happening and was told that the Dentist located
behind these houses is using the area behind these
houses for parking cars without proper authority, and
Dr. McDowell wants to demolish these houses to make
a parking lot all the way through to Rogers Street.
Called Scoff Kurleman and asked for his
suggestions regarding how to stop this. He suggested
we send a letter to the City Manager (Bill Horne) or call
his him at 562 -4040. If we make known our
disagreement loud and strong enough we should get
the necessary attention.
This needs to be done ASAP so that by the next
meeting, now scheduled for 1:00 PM January 24, 2001,
we could see some action. If you should have any
questions, or if 1 can be of any help regarding this
situation feel free to call meat 446 -7214.

Ethel Velboom gave me your e-mail address so that I could voice my
objections to a parking code violation by a Dr. Mcdowell of Court St. I
have lived at 1416 Rogers St. for 25 years. This is a quiet residential
area even though we are close to Court St. and I object very strongly to any
change on my street from a residential use to a commercial use. This Dr.
Mcdowell is already in code violation by pushing his parking behind his
office into the backyards of two houses on Rogers St. My neighbors and I
have learned that he would like to demolish these houses and extend his
parking onto Rogers St. Permission for this would be devastating for our
street. The increase in traffic could endanger the children in our
neighborhood and lower property values. Obviously Dr. Mcdowell has outgrown
his office space and needs to move to a larger facility instead of trying to
ruin our neighborhood. Thank you for your attention to this matter.
