Myrtle Avenue Clearwater, Fl 33756 -5520 RE: Central Production Studios 333 Chestnut Street Mr. Albee: PINELLAS COUNTY, FLORID 315 COURT STRE CLEARWATER, FLORIDA 33 This letter is addressed to you in order to help summarize the current status of the tree planting(s) that were required in order to secure a permanent "Certificate of Occupancy" for the Pinellas County Central Production Studio (CPS). The Pinellas County Central Production Studio is located at the southwest corner of Chestnut Street and Palm Avenue. During the land development review process the City of Clearwater required Pinellas County to plant (84 ") caliper inches of approved trees in order to compensate for the proposed removal of (84 ") dbh inches of tree material. During post construction negotiations regarding the CPS Pinellas County staff negotiated with the City of Clearwater regarding an approved location for the planting of the required replant trees. It was determined by the City of Clearwater that all of the compensatory tree plantings would have to be planted in the area of "Downtown" Clearwater. Following this directive Pinellas County designed a landscape plan that proposed tree plantings along the east side of the Pinellas Trail from Turner Street southward to a termination point north of Pinellas Street. The Pinellas County General Services Department created a proposal to plant (47) Live Oak trees and (34) Crape Myrtle trees along the east side of the Pinellas Trail between Turner Street and Pinellas Street. The remainder of the trees that were needed to meet the compensatory caliper requirement was approved for planting on Pinellas County owned properties that are in close proximity to the subject CPS building. The General Services Department prepared and submitted a compensatory tree - planting proposal to the City of Clearwater reflecting the aforementioned details. The City of Clearwater's Planning and Development Services Division approved the submitted tree - planting proposal. The intent of the compensatory tree planting criteria is to provide assurance(s) that (84 ") of tree caliper material was reintroduced and established in the downtown region of Clearwater. Pinellas County contracted the approved planting scheme to be planted and maintained with regular watering for the first twelve months. The planting effort that ultimately included (82) ten - gallon sized Live Oaks and (34) Crape Myrtles commenced on January 8, 2002 and the planting phase was completed on January 16, 2002. The installed Live Oaks were obtained from mature nursery stock of 10- gallon container size. On January 18, 2002 Pinellas County staff inspected the tree planting to determine the total number of inches that was provided by the contracted planting. The (82) Live Oak trees were measured for caliper dimension at six inches above the grade elevation, as specified by the Florida Department of Agriculture and Consumer Services (FDACS) "Grades and Standards for Nursery Materials." The computation of the observed data provides an average caliper dimension of (1.325 ") per Live Oak tree unit. The caliper dimension average of (1.325 ") multiplied by the 82 tree units provides (108.65 ") of planted tree caliper. Clearwater required (84 ") of tree caliper to satisfy the replant requirement. Therefore, this portion of the planting provides an excess of (24.65 ") of tree caliper that was required to satisfy City of Clearwater Certificate of Occupancy replant criteria. The (34) Crape Myrtles were purchased -from nursery stock of 15- gallon containers. The plants are an average height of (52 ") and have four or five well - developed stems that have an average caliper of (1 "). Using a (I") caliper average for the Crape Myrtles there is a net yield of (34 ") caliper inches that is the result of this portion of the subject planting. The total net caliper inches planted are (142.65 "). The total planted caliper of 142.65 ") yields an excess of (58.65 ") of caliper inches. Pinellas County will respectfully request to apply the excess (58.65 ") caliper inches to future replant needs associated with Pinellas County infrastructure construction. Pinellas County has contracted with Luke Brothers Inc. landscape contractors over the next twelve months to provide watering on a (three times a week basis) to help assure the establishment/success of the subject planting. Pinellas County is confident that by January 16, 2003 the subject landscape plantings will be well established during what is normally the peak of winter plant growth dormancy of mid January. Pinellas County would like to schedule a field review with you at your convenience. The field review will provide you an opportunity to inspect the plantings for confirmation of your acceptance. The trees to be planted shall be Florida Grade Number One or better and shall be a variation of Live Oak, Ligustrum, Wax Myrtle, Crepe Myrtle, Eastern Red Cedar, Southem.Red Cedar, and Bald Cypress. 4. SECTION 1 SCOPE OF SERVICES 1.1 SERVICES TO BE PERFORMED The COUNTY is required by conditions required by the City of Clearwater to plant approximately 47 live oak trees. The COUNTY also requires services to plant, monitor and maintain 44 live oak and 35 crepe myrtle trees. Maintenance is required on all trees planted on the Trail for a period of one (1) year. The CONSULTANT is also directed to refer to Exhibit "N'— PLANS, for details. The CONSULTANT shall provide all necessary services for planting, maintenance and monitoring activities required for the COUNTY to meet all required conditions imposed by the City of Clearwater. The services provided for in this scope of work shall include, but not be limited to, the following: Initial evaluation of existing plans; site preparation; purchasing; delivery of quality suitable plants (crepe myrtles); and all materials and equipment necessary to satisfactorily plant, maintain, and monitor the PROJECT areas to meet the requirements of this scope. 1.2 REGULATORY COMPLIANCE The CONSULTANT shall be responsible for maintaining current knowledge of all applicable local, state, and federal rules and regulations which govern the CONSULTANT'S work. The CONSULTANT shall also comply with all applicable governing specifications, regulations, documents, or controlling law of any governmental agency having jurisdiction over any part of the PROJECT. B. SECTION 2 SERVICES TO BE PROVIDED BY THE CONSULTANT 2.1 SCHEDULE AND PROGRESS REPORTS Subsequent to receipt of the "NOTICE TO PROCEED," and prior to submittal of the first invoice for fees earned, the CONSULTANT shall submit for the COUNTY'S approval a schedule for the initial evaluation, mobilization, planting, maintenance and monitoring of the PROJECT and any other work items comprising the total estimated work effort. The CONSULTANT shall submit to the COUNTY, not later than the first Monday of each month, a progress report reflecting the PROJECT status. The report shall show all work items completed as of the date of the preceding progress report. 2.2 INITIAL EVALUATION The CONSULTANT shall perform the following: A. Determine specific scope of work as required herein. B. Conduct periodic review of the construction site progress and provide professional assessment on implementation of any needed modifications. C. Review the plans and provide recommendations for modifications to the planting plans to modify, or redesign the plans based on existing conditions, if necessary. The plans are attached hereto and incorporated herein as Exhibit "A." Page 8 2.3 SITE PREPARATION AND REMOVAL OF UNDESIRABLE SPECIES (PRE- PLANTING) The work specified under this Section consists of the preparation of the project site(s) for planting by the removal of undesirable species from the areas shown on the plans. The CONSULTANT shall cause the undesirable species, through physical removal, chemical treatment, or other means, to cease to exist in a living state within the project area as shown on the plans. Removal must be done in a manner so as not to hinder the survival and growth of planted or naturally occurring desirable species. If chemicals are utilized (non -toxic to aquatic systems) proper selective herbiciding procedures shall be used by registered aquatic applicators licensed in accordance with the applicable laws /regulations /permits. The work shall include the following: A. Mobilize to begin work on the project, including but not limited to those operations necessary for the movement of personnel, equipment, supplies and incidentals to the project site(s), and for the establishment of safety equipment and first aid supplies, and sanitary and other facilities as required. B. Minor grading necessary to prepare the ground surface for planting. (Hauling of soil material to' and from the site shall be considered a Contingent Service.). C. Removal and disposal of undesirable species as specified herein and as indicated in the plans. The CONSULTANT shall effectively remove the undesirable vegetative species and shall ensure that the presence of the undesirable vegetative species is contained at the zero percent (0 %) level until the start of planting specified in the contract. D. The undesirable species and dead or decaying plants removed from the site shall be properly disposed of within.ten (10) days by the CONSULTANT in areas provided by the CONSULTANT. E. Completion of the effective removal must be accomplished prior to any plant installation. F. Undesirable Species shall mean Vegetation which is not conducive to or which inhibits or prevents the successful establishment of the desired vegetative community. Species classified as undesirable include, but are not limited to those plants listed in the current Florida Exotic Pest Plant Council's List of Florida's Most Invasive Species, as directed by the County's designee. 2.4 PLANTING The work specified under this Section consists of installing trees, and /or shrubs of the species, size and quantity indicated in the design plans issued for the PROJECT. The CONSULTANT shall perform or comply with the following: A. Participate in a pre - planting meeting to be held between the COUNTY and the CONSULTANT before work starts. B. Install all trees, and /or shrubs in those areas identified in the plans. Two defined scopes for planting are as follows; • Pinellas Trail — Plant and maintain 44 live oaks and 35 crepe myrtles shall be planted in an area from Turner Street to Pinellas Street, along the Pinellas Trail. • Downtown area — Plant approximately 47 live oaks throughout the downtown Clearwater area. C. Furnish and apply all other material including water and such accessory items as may be required to facilitate the planting and establishment of Trail trees, and /or shrubs specified to be installed. This establishment of trees shall be for a period of 12 consecutive months or as deemed substantially complete by the COUNTY. D. Tree base protectors shall be placed around trees installed under this Section, if required. Tree protectors shall be constructed of spiral wound plastic sheathing so as to expand automatically with the trees growth. Sheaths must extend vertically from the ground at the base of the trees to a minimum Page 9 height of twelve inches (12 "). Gaps in coverage shall be no greater than one - eighth (1/8 ") between wraps. E. The COUNTY shall provide Live oaks from their nursery located at 9300 98th Street North. The CONSULTANT shall furnish and install all crepe myrtles for the Trail. F. All trees, and /or shrubs provided to or by the CONSULTANT shall be nursery grown, Florida Grade No. 1 or better, or as applicable and as provided in the latest edition of Florida Grades & Standards for Nursery Plants, Florida Department of Agriculture and Consumer Services. Trees, and /or shrubs shall be installed no later than twenty -four (24) hours after delivery to the site or provisions shall be made for keeping them shaded and watered. G. The CONSULTANT shall be responsible for the pickup and delivery of all trees, and /or shrubs from the designated nursery to the project site. H. Plant material shall be installed at the soil depths at which it was originally grown. Substrate shall be watered and /or packed so as to eliminate air pockets. A planting well shall be constructed around each tree large enough to hold the required amount of water as specified in section 2.5 -C of this contract. I. The CONSULTANT shall be responsible for ensuring one hundred percent (100 %) survival of the Live Oaks and Crepe Myrtles planted along the Pinellas Trail trees, and /or shrubs required to be installed for twelve (12) months from the date of the County's acceptance of the planting phase of the project. The CONSULTANT shall also, within the said period, replace any and all trees, and /or shrubs that have deteriorated below the level of Standards for Plants. J. Ensure the presence of undesirable vegetative species is contained at the zero percent (0 %) level until the date of the COUNTY'S acceptance of the planting phase of the project. K. Upon completion of the planting phase of the project, the CONSULTANT shall notify the COUNTY in writing and, upon acceptance of the planting phase, prepare the Completion Report. Acceptance of the Planting Phase of the Project shall mean the written acceptance by the COUNTY'S designee of the plantings installed in accordance with the plans. Such acceptance by the COUNTY shall not relieve the CONSULTANT of the responsibility to continue to maintain, during the post - installation period (maintenance period) set forth in this document. 2.5 MAINTENANCE The work specified under this Section consists of maintaining the planting to meet or exceed requirements of this scope of work on an on -going basis. The CONSULTANT shall perform the following: A. Effectively remove undesirable species (Refer to Section 2.3 for list of undesirable species) within the PROJECT area. At any time during the maintenance period, the CONSULTANT shall ensure that the presence of the undesirable species is contained at the five (5) percent (5 %) or less level. Maintenance events shall be performed at the frequency necessary to ensure the specified levels of undesirable species, but in no case shall the events occur less frequently than monthly. B. Furnish and install trees, as described in section 2.4, and /or shrubs, within the PROJECT area to maintain the survival levels specified herein. C. Furnish and apply all other material including water and such accessory items as may be required to facilitate the continued establishment and success of all trees, as described in section 2.4, and /or shrubs specified to be maintained. During the driest time of a particular Pinellas County growing season plants can require up to 1/3" of water per day so that turgidity is retained. It is recommended that an average of 1/3" of water per day be provided to the subject trees. It is advised that the planting wells be filled three (3) times per week to provide a minimum of 2" of water to all areas of selected trees during the first 3 months post - installation. This may be reduced to once per week for the next 9 months. The source of water shall not be potable. The water source can not be of a saline source. The water should be applied in a manner that is non - erosive. Page 10 D. Ensure that the survival level of all planted vegetation is maintained at ninety percent (90 %) or greater, per site, during the maintenance period. Replanting of all trees, and /or shrubs shall conform to the requirements in the Planting section of this scope of work. A summary of replants installed shall be submitted to the COUNTY in the written maintenance report. The cost for replants shall be included in the price for Maintenance Areas. E. Remove and dispose of deadidecaying plants, trash, debris, etc., resulting from or encountered during maintenance activities. Plants and debris shall be properly disposed of by the CONSULTANT in an area provided by the CONSULTANT. F. A written summary of maintenance activities shall be submitted to the COUNTY quarterly during the maintenance period. 2.6 MONITORING The work specified under this Section consists of all monitoring activities required to comply with the scope of work. 2.6,1 The CONSULTANT shall furnish reports as follows: A. Four (4) original copies of each Monitoring Report in the format as shown in. the scope of work directly to the COUNTY on the first Monday of each month. These reports shall consist of the status of each tree planted and it's disposition for compliance. B. The above reports shall include Field Notes to support the findings. 2.6.2 Final Acceptance of the Overall Project Upon completion of the final maintenance and monitoring. event, and the PROJECT is found to be acceptable to the COUNTY, the COUNTY will make final acceptance and the CONSULTANT'S obligations under this scope of work shall end. . C.
