The meeting was very helpful and informative to the start of this exciting project. The meeting established areas of resolution relevant to the issues of public safety concerns that Opus has expressed to the City of Clearwater, resulting from the construction of this complex downtown high rise structure. I wish to recapitulate our understanding of steps Opus and the City of Clearwater have mutually agreed to in the interest of the public and the city: Tampa, FL 33607 Phone 813 -877 -4444 Fax 813 - 877 -1222 www.opuscorp.com • Opus will establish a perimeter safety zone of approximately 50 feet to the west and north of the property lines, and have responsibility for layout and survey of these. • Opus will install fencing per the attached Fencing and Staging plan elated 1.14.06. Our limits of authority to install fencing will be limited to the private property lines: east, south and north inside the curb line, per approval of Fencing and Right of Way permit applications submitted to City of Clearwater Engineering Department. (This is the same drawing referenced above). We will stop our fencing installation at the park property line to the west. • City of Clearwater will install a temporary safety fence and remove the trees along the westerly edge of the property line in the existing Park. • Final Landscape Plan development and restoration will be to the discretion of the City of Clearwater and in accordance with current city regulations. Opus will submit a preliminary landscaping plan of the west property line and onto the existing park. This is to be coordinated and installed per Engineering and Traffic direction. Opus will be responsible for this cost and coordination. All work is to be performed in accordance with existing ordinance. All Permitting and Right of Way applications will be the responsibility of Opus and to current ordinance and permitting requirement standards. We also discussed parking coordination in the City Hall parking lot, and in concert with the demolition and construction phases Opus proposes that during the demolition phase (approximately five to ten business days), we will provide at no cost to the City a one for one parking replacement for the existing 36 designated spots to be along the northern city parking lot, immediately adjacent to the church buildings that are to be demolished. The spots will be temporarily abandoned and Opus will provided designated parking on our existing property immediately across the street at 301 Pierce. Later on during the construction phase, we may have to relocate certain parking spots to accommodate immediate construction needs. Again, Opus will provide a one for one alternate parking arrangement at no cost to the City of Clearwater. I have attached several documents for reference: 1. Fencing and Staging Plans dated 1.14.06 2. Initial Landscape restoration plan 3. Tree survey of Public Safety Zone. Rod, I trust this document fully represents our understanding of this agreement. It is my understanding that the City of Clearwater will contact me to set up an additional meeting with your engineering staff to go over the feasibility of these items. Opus' design calls for storm piping to run along the north property as well as run piping along the south side of the property and turn north to tie into your newly designed Structure S -138 that will be installed next year. Opus requests confirmation that this will be allowed. Item 2: In order for this storm piping to be run along the outside of our building structures, we request an easement from the city at the north property line at the location of the garage as well as the west property line of the tower building itself. The reason for this is that our foundation footings and walls are not set back enough off the property line to run the Storm piping unless the City of Clearwater will allow Opus a 5 -10 foot Easement at these locations because the storm piping will be on city property. Opus requests confirmation that this will be allowed. Item 3: In order for Opus to construct two levels of our garage structure below existing grade, we will have to sheet pile along the north side of the garage footprint in order to support and protect Cleveland Street while we build the retaining wall system at this location. We request that the city allow Opus to sheet pile at the locations of the city sidewalks with the understanding that its feasibility will be based on avoiding existing utilities and underground lines. All restoration of this area will be the responsibility of Opus South. I have enclosed two requested options that should alleviate safety and traffic concerns as well as minimize the disruption to business operations at the City Hall property. With these staging options, Opus requests the ability to remove existing city trees along the bottom of the west bluff with the understanding that t e crty wi 1 dictate the required replacement types an Quantities if this is allowe nus will discuss our Togic behind this request at our next meeting. Item 5: Opus requests that our parking garage will be approved with 18'- 24' -18' parking spacing and drive aisle dimensions in lieu of the city's 19'- 24' -19' normal criteria. Our understanding is that the city has given the tacit approval for this change to the Aqua Condominium and mixed use project that will be located to our northeast at the Cleveland St. and Ft. Harrison intersection. This will allow Opus to decrease our parking structure depth 4 feet and allow additional setback dimensions at the north wall of our garage.
