The City of Clearwater Planning Department has done an inspection at the above address and has found
the property is in violation of the following City code:
Section of City Code violated: 3- 1204.L. Facts behind violation: **DEAD, DECLINING, MISSING AND
DISEASED PLANT MATERIAL't* shall be replaced with healthy material of similar type in keeping with the
landscaping requirements at the time of original planting and in accordance with the approved landscape
plan.
Specifically, To be in Compliance with section 3 -1204 you must install and replace the
following plant material listed on the property. I will list the plant material according to the
labeled landscaping plan sheets L -1, L -2, and L -3. Missing and dead plant material in L -1
Muhly Grass along south side of C.R. 31 across parking area. Replace dead and missing
Wild Lantana, Shield Fern, Saw Palmetto, and 1 Loblolly Bay tree on the trail between C.R.
31 and the begining of the Wall. Replace3 the Fakahatchee Grass and Muhly Grass, Oakleaf
Hydrangea, Butter Fly Garden, Beautyberry, Shiny Blueberry, Shiny Leaf Coffee, Saw
Palmetto, Fire Bush, Yellow Necklace Pod, Indian Grass, and 3 Loblolly Bay trees along the
trail from the begining of the wall to Tampa Bay. L -2 replace missing and dead Elderberry,
Beautyberry, Florida Privet, Wheeping Yaupon, Milk Weed, Shield Fern, Fire BUsh, Butterfly
Garden ?, Shiny Blueberry, Simpson Stopper, and wild Lantana, Replace 1 missing Dahoon
Holly on West perimeter. L -3 Replace dead and missing Shield fern, Muhly Grass,
Fakahatchee Grass, Saw Palmetto, Beautyberry, Florida Privet, and Elderberry throughout
the interior of the park in L -3. Replace 5 missing Dahoon Holly trees in the Northwest corner
of the property. Replace missing and dead Muhly Grass, Shield Fern, Mimosa, Beautyberry,
Wheeping Yaupon, Fakahatchee Grass, and Fire Bush in Landscaping beds along the Gulf
to Bay perimeter. Mulch any and all landscaping beds on the property according to Section
3 -1204 Part B.
No further action is required on your part if the violation is corrected by September 01, 2008.

I attended a meeting with the developer, architect, consulting arborist(Norm Easy, past president of the southern chapter
of the ISA), Alan Mayberry and Tim Kurtz to review proposed plans for the property. Code requirements were explained,
inch for inch replacements (preliminary figures of 900 inches @ $48 per inch equals $43,200 prior to landscape plan
credits), no removal of specimen trees or tree stands, tree inventory required by a certified arborist entailing tree size,
species, and condition. The developers arborist stated that a large percent of the existing trees on site were specimen
and it would be difficult to develop the property without taking them out.
After a brief review of the proposed plans, it is city staff opinion that the site is still over developed and minimal
consideration was given to the preservation of the trees. The parking was twice what the code required. The reduction of
the excess spaces and possibly adding an additional floor to the garage would increase the number of specimen trees to
be preserved on site.
