EASEMENT
FOR AND IN CONSIDERA TION of the sum of One Dollar ($1. 00)
cash in hand paid to it, the receipt of which is hereby acknowledged, and
the benefits to be derived therefrom, BOARD OF PUBLIC INSTRUC TION OF
PINELLAS COUNTY, FLORIDA, does hereby grant and convey to the CITY
OF CLEARWATER, FLORIDA, a municipal corporation, a construction
easement over, under and across the following described land, lying and
being situate in the County of Pinellas, State of Florida, to wit:

Begin at the/NW 1/4 of the NE 1/4 of Section 24, Township
29 South, Range 15 East; thence North 50 ft., thence East 115
ft. for a Point of Beginning, said point being the Northwest
corner of the intersection of Hercules Avenue and Lakeview Road
as platted; thence run Westerly along the North right of way
line of Lakeview Road 360 ft., thence North 25 ft., thence
Easterly 360 ft. M. O. L. to the West right of way line of Hercules
Avenue; thence South 25 ft., M. O. L. along the said West
right of way line of Hercules Avenue to the P. O. B. ; the easement
thus described lying and being situate in the tract of land
described as follows:
Begin at the SW corner of the NW 1/4 of the NE 1/4 of Section
24, Township 29 S" Range 15 E, for a point of beginning; run
thence N 8g009' 04" W. along the 40 acre line, 1325.39 feet;
thence N 0 03'18" E. along the 40 acre line 427.94 feet; thence

S 89 18'54" E. 1309,76 feet; thence along the arc of a curve
to the left 67,86 feet; whose chord is S 14045'11" E, 67,82
feet; and whose radius lS 588, 38 feet; to a point on the N-S
half section line; thence continue along the arc of the same curve
to the left 117,73 feet; whose chord is S 23047122" E, 117.53
feet and whose radius is 588.38 feet, to a point of reverse curve
to the right, whose arc is 271. 77 feet, and whose chord is
S 14006'36" E, 268, 78 feet, and whose radius is 528.38 feet;
thence N 89003'44" W., along the 40 acre line, 115,0 feet to the
P. O. B., containing 13,6 acres more or less,
It is hereby mutually agreed that this construction easement is
granted for the purpose of permitting the Grantee to install a permanent
sanitary sewer line in a location within the limits of the said easement as
shall be determined by the Grantee to be most suitable for such permanent
installation; and it is further mutually agreed that upon completion of the
permanent installation the legal description of the said installation will be
expressed in a permanent easement from the said Grantor to the said
Grantee and made a matter of record; and that the portion of the area
herein described as a construction easement which is not used for the
permanent installation as aforesaid, ushall be vacated by the Gr ant eed and
shall revert to the Grantor.
It is further mutually agreed that, during the course of construction
within the limits of this easement, a satisfactory temporary sidewalk will
be provided by the Grantee; and upon completion of construction, in the
event the existing permanent sidewalk lying in and adjacent to the limits
of this easement shall have been damaged or removed, the same shall be
restored to the satisfaction of the Grantor.

The CITY OF CLEARWATER, FLORIDA, shall have the right to
ent er upon the above described premises and to construct within the said
premises a permanent sanitary sewer line as hereinbefore provided.
This construction easement shall expire automatically after one
year from date hereof or upon the completion of the project, whichever
is sooner, unless extended by written agreement of the parties hereto,
IN WITNESS WHEREOF, the party hereto has caused these presents
to be duly executed by its proper officers thereunto authorized and its seal
to be hereunto affixed this 22nd day of June , 1966.
