on the Premises, a portion of which will be located on and over the location
of the present drainage ditch; and
WHEREAS, Owners are willing to create a drainage easement in
a location on the Premises that will not be occupied by Owners' proposed
building, provided that Clearwater releases and vacates any and all rights
which it or the public may have in and to the existing location of the open
drainage ditch; and

NOW, THEREFORE, in consideration each to the otheT given,
and in consideration of the actions and agreements hereinafter
set forth, the receipt whereof by each of the parties hereto is
hereby acknowledged, the parties hereto agree as follows:
1. The City of Clearwater will quit claim unto Owners
any and all rights and easements, which the City or the public may
have (except as~rovided herein) to conduct storm water drainage
or any other wawer or sewer pipes or facilities through any por-
tion of the Premises, including without limitation any such rights
in the existing drainage ditch now located on the Premises, said
quit claim will be provided after the alternate system is installed
in accordance with Building Permit No. 2l59E, dated April 12, 1983,
issued by the City of Clearwater.
2. Own~s hereby grant to Clearwater for the use of the

(a) The right and easement to maintain, repair,
replace and use the easement area shown and legally described on
map attached hereto and marked Exhibit A, the drainage pipe or
pipes to be installed to City standards by Owners at Owners'
expens e, being a 36" RCP, pursuant to Bu ild ing Permi t No. 1259 E,
dated April 12, .;L983, issued by the City of Clearwater.
(b) ~he right and easement at any time and from time
to time to enter upon the Premises and the drainage easement in
connection w1th the exercise of any of the foregoing rights.
3. Owners agree that easement cannot be relocated ~ith-
out prior permission and acceptance by the City of Clearwater.
4. Owners reserve the right to use the surface and air
space over the sprface of the easement area for all purposes not
inconsistent wi~h the easement hereby granted.
