AN ORDINANCE O THE CITY OF CLEARWATER, FLORIDA,
AMENDING 1-HE EFFECTIVE DATE OF ORDINANCE NO. 5533-94
WHICH AMENDED THE FUTURE LAND USE ` ELEMENT OF THE
COMPREHENSIVE PLAN OF THE CITY TO CHANGE THE LAND USE
DESIGNATION FOR CERTAIN REAL PROPERTY LOCATED ON THE
WEST SIDE OF MCMULLEN-BOOTIE ROAD ACROSS FROM ITS
INTERSECTION WITH BRIAR .CREE`K BOULEVARD, CONSISTING OF
PARCEL A TURTLE BROOKE SUBDIVISION, WHOSE POST OFFICE d�
ADDRESS; lw"i 3190 MCMULLEN-BOOTH ROAD, FROM RESIDENTIAL
SUBURBA14 TO INSTITUTIONAL; PROVIDING FOR SEVERANCE;
PROVIOING AN 'EFFECTIVE DATE.
WHEREAS, Ordinance No. 5533-94E was adopted on second reading on February
3 1994, amend i ngi they future land use plan element for Parcel A, Turtle' B ooke
Subdivision, and 1,establishing :an effective. date; and
WHEREAS, Section 3 of said ordinance does not make the effecti ve l date
contingent upon the determination by the state land planning ,agency of the
Administrative Co rission of the State of Florida, as appropriate,' of compliance
with the applicable requirements of 'the Local Government Comprehensive Pla�nincg '
and Land Develop�ent Fegulation Act, pursuant to § 163.3189; Florida Statues; ,
and
WHEREAS, the Florida Department of Community Affairs has informed he City
that it will not process this future land use plan amendment until the ordinance
is amended to include such requirements; now,. therefore,

CLEAkWATER, FLORIDA:
Section 1. �Sect:,on 3 of Ordinance No. 5533-93'is deleted and the following
Section 3 is substituted:

Government Comprehensive Planning and Land Development Regulation '
Act, pursuant to § 163.3139, Florida Statutes. The Director` of
Central Permitting is authorized to transmit to the Pinellas County
Planning Council an application to amend the Countywide Plan in
order to achieve consistency with the Future Land Use Plan Element
of the City' s Comprehensive Plan as amended; by this ordinance.
Section 2. All other provisions of Ordinance No. 5533-94 remain as :Mated
in the adopted ordinance.
