DRAINAGE EASEMENT AGREEMENT
THIS FIRST AMENDMENT TO DRAINAGE EASEMENT AGR~~T, dated January 21,
1977, is made and entered into this 14---r1l day of N OVEMI E~ " 1977,
by and between FLORIDA P(MER CORPORATION, a Florida corporation, Party of the
First Part, "GRANTOR" therein, and the CITY OF CLEARWATER, FLORIDA, a municipal
corporation of the State of Florida, Party of the Second Part, "GRANTEE" therein.

WHEREAS, the parties hereto entered into that certain Drainage Easement
Agreement as recorded in O.R. Book 4514 at Page 1959 as Clerk's Instrument No.'
77029080 of the Public Records of Pinellas County, Florida, wherein GRANTOR does
grant and convey unto GRANTEE and to its successors and assigns, the right,
privilege and easement to install, construct, reconstruct, operate and maintain
underground storm drainage pipes, manholes and endwa11s centered within four
separate 20-foot wide Easement Areas extending across GRANTOR'S 208-footwide
fee-owned right-of-way corridor comprising the West 208 feet of Section 20, Town-
ship 28 South, Range 16 East, Pine11as County, Florida (as established by deed
recorded as Clerk's Instrument No. 998388A, Public Records of Pinellas County,
Florida);
WHEREAS, the parties are desirous of including an additional EASEMENT
AREA to said Drainage Easement Agreement.

NOW, THEREFORE, it is mutually agreed as follows:
1. That the Drainage Easement Agreement is hereby amended to include
EASEMENT AREA NO.5:

Commence at the NW corner of Section 20, Township 28 South,
Range 16 East, thence run S 0005'21"E, along the west '
boundary of said Section 20 (being also the west boundary
of GRANTOR'S 208-foot wide right-of-way corridor, for
1288.91 feet to the Point of Beginning of the centerl ine
of a 20-foot wide Easement Area defined as lying 10 feet
on each side of said centerline which bears N 89054'39" E
for 208.00 feet to the Point of Termination of said
centerline on the east boundary of said right-of-way
corridor.

THE LOCATION AND EXTENT OF THE ABOVE DESCRIBED 20-FOOT
WIDE EASEMENT AREA ACROSS GRANTOR'S 208-FOOT WIDE FEE-OWNED
RIGHT-OF-WAY CORRIDOR IS SUBSTANTIALLY AS SHOWN ON PRINT OF
SKETCH ATTACHED HERETO AS EXHIBIT "A" AND BY THIS REFERENCE
INCORPORATED HEREIN AND MADE A PART HEREOF.

That all rights, restrictions, terms and conditions as stated
in said Drainage Easement Agreement dated January 21, 1977,
shall likewise apply to additional EASEMENT AREA NO. 5 as
provided herein.
3.
That the said Drainage Easement Agreement dated January 21,
1977 shall otherwise remain unchanged.
