EASEMENT
FOR AND IN CONSIDERATION of the sum of One Dollar ($1. 00) cash
in hand paid to them, the receipt of which is hereby acknowledged, and the
benefits to be derived therefrom, REV. E. C. CHASTAIN, Pastor, and JOE L.
GREEN, ARTHUR D. LAWSON and AUBREY W. ORT, Trustees of Trinity
Baptist Church, do hereby grant and convey to the CITY OF CLEAR WATER,
FLORIDA, a perpetual easement over, under and acros s the following
described land, lying and being situate in the County of Pinellas, State
of Florida, to wit:
- The-South 30 feet of the North 47 feet of theEast 35
feet of Lot 196, Morningside Estates, Unit 1, according
to map or plat thereof as recorded in Plat Book 59,
page 59 of the Public Records of Pinellas County, Florida.
By the terms of this Easement the Grantee, City of Clearwater, is
hereby granted the authority to use said described real property together
with all existing water wells, pumps and other fixtures thereon and to
extract from said property such quantities of water as it may desire in
its sole discretion during the term of this Easement.
The City of Clearwater is further granted the right to add additional
wells, and to repair, enlarge or modify the existing well, pumps and all
fixtures placed thereon as it in its sole discretion deems necessary and
proper during the term of this Eas ement.
In the event that the Grantee, City of Clearwater, shall completely
discontinue the use of said easement and all wells thereon for a period of
six (6) consecutive months durmg any calendar year, then this easement,
at the option of the Grantor hereunder, shall immediately cease and
terminate. Upon the ceasing and termination of this easement for any
reason or cause, the Grantee, the City of Clearwater, or its assigns,
shall have the right to promptly remove any and all equipment and fixtures
placed by it on said property during the term of this easement.
