CABANA CLUB CONDOMINIUM ASSOCIATION INCORPORATED ~, J I RESOLUTION OF CABANA CLUB CONDOMINIUM ASSOCIATION, INe. REGARDING EASEMENT WHEREAS, the City of Clearwater, Florida has requested Cabana Club Condominium Association, Inc. ("the Association") to grant a public access easement over a portion of the condominium property; and WHEREAS, the Association has determined that it has the authority to grant the easement pursuant to the Florida Statutes and condominium documents, and that such easement would be compatible with the best interest of the owners and the condominium; and NOW, THEREFORE, it is hereby resolved, as follows: 1. The public access easement presented to the Board of Directors at its meeting of October 21, 1996, is hereby approved, and Kay Korwin is hereby authorized as President of the Association to execute the easement on behalf of the Association. I HEREBY CERTIFY that the above resolution was duly adopted by the Board of Directors at its meeting of October 21, 1996, following notice in accordance with applicable law. I made a copy for our file. This resolution does not need to be recorded in the public records, but should be kept in the policy and procedure section, or as an exhibit to the rules and regulations of the Association. I am also returning the resolution that was executed regarding the beach access easement. I have forwarded the public access easement document to the Clerk of the Court with a check to cover the recording fee, but the resolution of the Association regarding this, and the resolution of the City of Clearwater are not to be recorded. I would suggest that you send the original resolution of the Association to the contact person with the City of Clearwater, and notify them that we have sent the public access easement to the Clerk's office for recording. WHEREAS, the government of Pinellas County is currently administering a beach renourishment improvement project on Sand Key in Clearwater, and WHEREAS, the project seeks funding from the Florida State Department of Environmental Protection by way of the Florida Beach Erosion Assistance Program, and WHEREAS, a necessary requirement for funding is the provision of public access and public parking for those citizens who wish to enjoy the results of the improvements, and WHEREAS, the City of Clearwater has been a proponent and sponsor of the Sand Key beach improvements since the project's inception, and WHEREAS, the Florida Department of Environmental Protection now requests that the City of Clearwater reaffirm its commitment relative to public access and parking by the adoption of a resolution declaring the same; now, therefore, . BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: (; ~ 1. That the City of Clearwater is committed to maintaining the existing PUbli~ access easement located astride the property line between Ultimar Three Condominiums at 1560 Gulf Boulevard and The Cabana Club Condominiums at 1582 Gulf Boulevard. . That the City of Clearwater will, on or before the completion of the beach erosion control project known as Sand Key Phase IV, construct a 75 space parking facility on the 3.8 acre site acquired for that purpose located at 1551 Gulf Boulevard in Clearwater. The easement was executed by Ms. Korwin on October 25, 1996 and recorded in O. R 9519, Pages 736 - 740 on November 8, 1996 by association attorney Michael 1. Brudny prior to having it returned to City staff for presentation to and acceptance by the City Commission. A copy of Mr. Brudny's 1l/6/96 letter to association Property Manager, Steve Strong is attached for reference. The original recorded easement document is in your files. Sue Diana provided me with a copy last week. I will pass a copy along to Bill Shepard for recording on the City atlas. I will also follow-up with John Carassas to see the Commission is informed that the easement has been given and that it completes administrative action necessary for the City to meet its commitment undertaken in Section 1 of Resolution 95-75 dated September 21, 1995 relating to beach access on Sand Key for the pending beach restoration project.
