FOR AND IN CONSIDERATION of the sum of One Dollar ($1.00) cash in hand paid to
SOUTH GATE HOME OWNERS, INC" a Florida corporation not-for-profit, the receipt of which
is hereby acknowledged, and the benefits to be derived therefrom, SOUTH GATE HOME
OWNERS, INC" does hereby grant and convey to the CITY OF CLEARWATER, FLORIDA, a
municipal corporation, an easement over, under, and across the following described land, lying and
being situate in the County of Pinellas, State of Florida, to wit:
A ten (10) foot wide easement lying along the East property line of Lot 4, Sever Park,
according to the map or plat thereof, as recorded in Plat Book 90, Page 59, of the
Public Records of Pin ell as County, Florida, being more particularly described as:
Begin at the Southeast comer of the aforementioned Lot 4, thence N 880 57' 10" W,
along the South boundary line of said Lot 4, 10,00 feet; thence N 010 03' 04" E,
10,00 feet West of and parallel to the East boundary line of said Lot 4, 838,89 feet;
thence S 460 37' 13" E, 13,53 feet to the East boundary line of said Lot 4; thence S
010 03' 04" W, along the aforementioned East boundary line, 829.78 feet to the Point
of Beginning,
The CITY OF CLEAR WATER, FLORIDA, shall have the right to enter upon the above
described premises to construct, install, and maintain thereon water lines for an emergency water
system, and to inspect and alter such water lines and facilities as may become necessary from time
to time,

SUBJECT: Water main easement - South Gate Mobile Home Park

Attached is the executed original of the above referenced easement document, and the
executed original of the related Affidavit Of No Liens, A completed DR-219 is also
attached for your signature,
I spoke to the Grantor's attorney, Jonathan Damonte, about obtaining a consent-to-
easement from Mr, Sever, the first lienholder. Mr, Damonte spoke with Don McFarland,
attorney for Mr, Sever, Apparently Mr, Sever passed away last week. Mr, McFarland
does not foresee a problem with the easement grant. At least for the time being, both
attorneys are comfortable without documenting the consent. From the City standpoint, I
understand the water line is already in place and only a meter is required to cDmplete the
emergency water system the Pinellas County Health Department requires being completed
by next month, In the highly unlikely event the easement interest would ever be impaired
by the lack of formal consent, the cost of removing the improvements is very minimal.
Please present the easement to the City Commission for acceptance, and forward
thereafter with the Affidavit to the City Clerk for recDrding.

COUNTY OF PINELLAS
BEFORE ME, the undersigned authority, personally appeared SHERLIE M, BURNS, who,
being first duly sworn, deposes and says:
1. That she is the Treasurer of SOUTH GATE HOME OWNERS, INC" a Florida
corporation not-for-profit, which is the owner of legal and equitable title to the real property
described in the attached Exhibit "A."
2, That said property is now in the possession of the record owner, subject only to the rights
of tenants in possession,
3, That there has been no labor performed or materials furnished on said property for which
their are unpaid bills for labor or materials against said property,
4, That there are no liens or encumbrances of any nature affecting the title to the property
hereinabove described, except for that certain purchase money mortgage in favor of SEVER
CORPORATION, a Florida corporation, recorded in O,R. Book 6980, Page 1308, as modified in
O,R. Book 9327, Page 331, Public Records of Pine lIas County, Florida,
5, SOUTH GATE HOME OWNERS, INC" warrants that no notice has been received for
any public hearing regarding assessments for improvements by any government entity, and that there
are no unpaid assessments against the above-described property for improvements thereto by any
government entity, whether or not said assessments appear of record, except for that certain
Agreement for Standby Water Service Connection dated June 6, 1995, between SOUTH GATE
HOME OWNERS, INC" and THE CITY OF CLEARWATER, FLORIDA.
6, That there are no outstanding sewer service charges or assessments payable to any
government entity, except current charges to THE CITY OF CLEARWATER, FLORIDA.
7. That the representations embraced herein are for the purpose of inducing THE CITY OF
CLEAR WATER, FLORIDA, it agents, successors and assigns to rely thereon,
