nlIS AGREEME~T, entered into this the

, 1971, by and between the CITY OF CLEARWATER,
a municipal corporation of the State of Florida, hereinafter called the
City, party of the first parti and the BOARD OF COUNTY COMMISSIONERS OF
PINELLAS COUNTY, FLORIDA, hereinafter called the County, party of the
second part,

WHEREAS, the City and County are desirous of obtaining a
drainage easement lying in Section 17, Township 29 South, Range 16 East,
and being further described as follows: The South 25 feet of the North-
west quarter (NW~) of the Northeast quarter (NE~) of Section 17, Township
29 South, Range 16 East, less the West, 530 feet M.O.L.i and
WHEREAS, this drainage easement area lies outside the City
limits of Clearwateri and
WHEREAS, it would be to the mutual advantage of both parties
for the County to acquire this drainage easement.
NOW THEREFORE, in consideration of the mutual performance of
the terms and conditions contained herein, the City does agree to the
following:
That a drainage easement lying in Section 17, Township
29 South, Range 16 East, and being further described as
follows: The South 25 feet of the Northwest quarter (~TW~)
of the Northeast quarter (NE~) of Section 17, Township 29
South, Range 16 East, less the West 530 feet M.O.L. and
lying outside the City limits of Clearwater will be
obtained by the CountYi that the City will reimburse the
County in the sum of two thirds of the total approved
appraised value or court awarded value of this drainage
easement. That the repayment to 'the County by the City
will be made on or before ninetv (90) davs after acquisition

It is recognized that by making the above mentioned repayment,
the City will satisfy its responsibility on this project, and any
additional expense in obtaining the drainage easement will be borne by
the County.
IN WITNESS WHEREOF, the parties hereto have caused this
instrument to be signed by their proper officers authorized so to do,
the day and year first above written.
