AGREEMENT
THIS AGREEMENT, made and entered into this

, 1968, by and between MAY E. MACKEY, a widow,
hereinafter referred to as "Owner'l, and the CITY OF CLEARWATER,
FLORIDA, a municipal corporation, hereinafter referred to as "City";
WITNESSETH:
WHEREAS, the City of Clearwater requires property hereinafter
described for utility easement purposes, and said Owner is willing to
grant such easement to the City under certain conditions;
NOW, THEREFORE, in consideration of the premises and other
good and valuable considerations, it is agreed as follows:
1. The Owner agrees to grant unto the City of Clearwater, Florida,
a municipal corporation, a utility easement, as hereinafter set out, over
the following des cribed property:
A permanent utility easement over the East 15 feet of
the North 60 feet of the South 330 feet of the East 100
feet of the West 830 feet of the Southwest 1/4 of the
Northeast 1/4 of Section 17, Township 29 South, Range
16 East, Pinellas County, Florida,
at and for the sum of One Hundred Twenty Dollars ($120. OO); and the
Owner hereby agrees that said consideration shall be inclusive of all costs.
2. The City agrees that if and when a sanitary sewer line is available
and the property is required to be connected thereto, it will waive the tap
fee for said connection.
3. This contract shall be binding on the heirs, succes sors and
assigns of the parties hereto.
