EASEMENT
NO. 23251
THIS EASEMENT, made this 17th day of December, A. D.
1962 by and between the TRUSTEES OF THE INTERNAL IMPROVEMENT FUND
OF THE STATE OF FLORIDA, as the grantors, and the CITY OF
CLEARWATER, FLORIDA, a municipal corporation, as the grantee.
WITNESSETH: That Whereas, the City of Clearwater, by
its Resolution No. 62-130, adopted December 3, 1962 requested
grant of a permanent easement as hereinafter described, together
with a one-year construction easement as hereinafter described,
all on sovereignty lands of the said Trustees of the Internal
Improvement FundI for installation of the Clearwater East
, Interceptor Sanitary Sewer Line, and Whereas, said request having
been approved by said Trustees in regular meeting December II,
1962,
NOW, THEREFORE, the Trustees of the Internal Improvement
Fund of the State of Florida, for and in consideration of the
sum of One Dollar and other valuable considerations paid, receipt
of which is hereby acknowledged, do hereby remise, release and
grant unto the City of Clearwater, Florida, subject to the con-
ditions and provisions hereinafter described, (1) a perpetual
easement in and to that portion of the submerged lands in Old
Tampa Bay landward of the established offshore bulkhead line and
Southerly of William Brown's Subdivision of Bay View, according
to plat recorded in plat Book 1 at page 13 of the public records
of Hillsborough County, Florida lying each side of and with 7~
feet of the centerline hereinafter described, and (2) a one-year
construction easement in and to an additional 7~ feet each side
of and adjacent to the said perpetual easement, said centerline
being described as:
Commencing for point of reference, at the Southeast
corner of Lot 16 of said William Brown's Subdivision
of Bay View, and running thence South 00 371 03" West
along the Southerly extension of the Easterly line of

said Lot 16 a distance of 38.58 feet for Point of
Beginning of said centerline, in Old Tampa Bay, said
point being 413.54 feet West and 894.59 feet South
from the Northeast corner of SE\ of Section 17, Town-
ship 29 South, Range 16 East; thence running North
810 33' 55" West 218.95 feet; thence South 880 19' 32"
West 290.55 feet; thence South 690 461 OS" West 404.55
feet; thence South 780 251 55" West 299.40 feet; thence
South 560 27' 25" West 224.85 feet; thence South 700 27'
1811 West 88.15 feet; thence North 890 221 57" West 26
feet to end of said centerline at a point South 00 371
03" West 1217.88 feet along the Westerly line of said
William Brown's Subdivision from quarter section line,
EXCEPTING, however those portions of the submerged
lands heretofore conveyed to Charles R. Anderson and
Celestine A. Anderson, his wife,
for the construction and installation of a sanitary sewer line,
together with the right to maintain the same subject to the
condition hereinafter mentioned.
This Easement is granted subject to the following
'provisions and conditions, viz:
(a) That said sanitary sewer line will be buried below the
natural bottom of Old Tampa Bay.
(b) That the City of Clearwater will save harmless the Trustees
of the Internal Improvement Fund from all damages and claims
arising out of the exercise of the easement privilege hereby
granted.
(c) That the right to maintain any sanitary sewer line installed
in and under said submerged land shall not in anywise extin-
guish or sever any right of any riparian proprietor or owner
of the upland to which the submerged land affected by this
easement is riparian, and in the event of conveyance of said
submerged land by the Trustees of the Internal Improvement
Fund then any operations by the City of Clearwater to repair
or maintain said sanitary sewer line shall be done only with
the consent or under authorization by the owner of said
submerged land.
(d) In the event the land herein described shall cease to be
used for the purpose herein authorized, then the easement
privilege herein conferred shall automatically terminate.

Improvement Fund of the State of Florida have hereunto subscribed
their names and affixed hereto the seal of the DEPARTMENT OF
AGRICULTURE OF THE STATE OF FLORIDA, at the Capitol, in the City
