Gentlemen:
Re: Acceptance of permit
granted by the City Com-
mission on March 17, 1930,
to use, cross and traverse
highways in the City of
Clearwater for the construction
and maintenance of underground
water pipe line.
The Pinellas Water Company hereby accepts the terms and con-
ditions of resolution and permit granted by the City Commission
of the City of Clearwater, Florida, on March 17th,1930, grant-
ing to the Pinellas Water Company and to its successors and as-
signs, the right and authority to use, cross and traverse cer-
tain county highway'" in the City of Clearwater known as the
"Gulf-to-Bay Boulevard" in accordance with the said permit.
We also accept the terms and conditions of permit granted by
bhe City Commission on March 17th,1930, giving and granting
to the Pinellas Water Company and to its successors and assigns,
,"ir11ege"a~d authority to cross and traverse certain
natural wateI'Ways'll<<t~h't!rmet"'tj'lrm14t.~ located on private lands
in Section 17, Township 29 South, Range 16 East, in accordance
with the said permit.
The Pine lIas Water Company undertakes to carryon its work of
construction and laying the said pipe line and/or water mains
in workmanlike mann'8:rbdi&Gcording tQs,tandard pJ:.'8.ctice in
accordance with its application filed with the City Commission
on March 17th, 193e:f"&M""fu.!-theragrees that before said con-
struction work is commenced that it will notify the City En-
gineer a reasonable time in advance in order that the City
may have notice that the Company is about to start operations.

RESOLUTION AND PEllinIT
WHEREAS, the Pinellas Water Company, a Florida cor-
poration, has filed written application dated March 17th, 1930,
with the City Commission of the Cityof' Cle arwater, Florida,
for a permit to be granted to it to use, cross and traverse
a highway in the City of Clearwater, known as t1Gulf-to-Bay
Boulevard" at a point approximd; ely 708 feet West of the Center
of Section 17, Township 29 South of Range 16 East, for the con-
struction and maintenance of an underground water pipe line
and/or water mains~
NOW, THEREFORE, BE IT RESOLVE.'D, by the City Commission
of the City of Clearwater, Florida, that a permi t be and is
hereby granted to the Pinellas Water Company, a Florida cor-
poration, and to its successors and assigns, to use, cross
and traverse a certain highway in the City of Cle arwat er, Florida
known as "Gulf-to-Bay Boulevard" at a point approximately 708
feet West of the Center of Section 17, Township 29 South of
Range 16 East, for the construction of water pipe line and/or
water mains in accordance with its written application filed
with the City Commission on March 17, 1930, and subject to the
following terms and cond~tions, to-wit:
Section 1. That the Pinellas Water Company shall fur-
nish the City Engineer a detailed plan of tre highway cro ss ing
showing accurate location and grade of the pipe line and/or
water mains, said plan to be approved by the City Engineer.
Section 2. That the Pinellas Water Company shall con-
duct the work (f construction and laying the pipe line andlor
water mains in a workmanlike manner and according to standard
practice, and that in the construction of the work and in the
replacement of the right of vay traversed, that the said Pinel 19. s
Water Company will restore the highway to as good a condition as

it is at the t:1me the s sme is disturbed, such condition to be
satisfactory to the City Engineer, that the Pinellas Water
Company shall conduct it s operations in such a manner as to
protect am facilitate the travelling public and not to un-
necessarily interfere with traffic, and that not more than
one half of the travelled highway will be closed to traffic
at one time.
Section 3. That the Pine lias Water Company shall post
and file with the City Connnissioners of the City of Clearwater,
a bond in the amount of $1000.00 condi tioned to guarantee the
restoration 0 f the right of way traversed in as good c andition
as when displaced and to guarantee and indemnify the City of
Clearwater for replacement for right of way traversed and pave-
ment cros sed, and further conditioned to guarantee ani hold the
City of Clearwater harmless against any maintenance work nec-
essary after said construction for a period of 12 months there-
after.
Section 4. That the Pinellas Water COlllpany agrees that
in the construction of its said pipe line that it will protect
the water mains, gas mains and/or other public utilities of
the City of Clearwater occupying the rigpt of way prior to
occupation by the Company.
Section 5. That the Pine lIas Water Company shall
hold and save harmless the City of Clearwater against any
damage or los s occasioned or arismg out 0 f the construction
and maintenance of its pipe line and/or water mains as herein
provided.
Passed and adopted by the City Commission in regular
session assembled the 17th day of March, 1930.
