EASEMENT
FOR AND IN CONSIDERATION of One Dollar ($1.00), the receipt of which is
hereby acknowledged, and pursuant to paragraph II of the Agreement between the City
of Clearwater, Florida (CITY) and Pinellas County, Florida (COUNTY) dated November
20, 1973, the CITY grants to the COUNTY an easement upon the City-owned jetty
located on the upland property adjacent to the westerly portion of Clearwater Pass
Navigational Channel in the vicinity of the north end of Sand Key, legally described in
attached Exhibit "A," and depicted in Exhibits "B" and "C".
The COUNTY shall use the subject property only for access to the artificial
reef staging project and such other uses as are consistent with the project. The
COUNTY may improve the subject property to provide more efficient and expeditious
handling of material. In furtherance thereof, the COUNTY may place a protective
fender system with "dolphins" along the seawall. This and any other improvements shall
be paid for by the COUNTY and become the property of the CITY upon completion. All
plans for a proposed improvement shall be submitted to the City Manager prior to
constructing the same. The COUNTY shall permit the CITY immediate use of the
property and facilities during emergencies. Further the COUNTY shall permit the CITY
joint usage for purposes of maintenance, dredging and storage of dredging equipment.
Lastly, the COUNTY shall hold the CITY harmless for all liability arising out of the
COUNTY's use of the subject property.

in its name by its City Manager, City Clerk, countersigned by its Mayor-Commissioner,
and approved as to form and corre.ctness by its City Attorney, and its corporate seal to

Commencing at the Southwest Corner of said Section 17, run
N 890 10' 31" E along the South line of said Section 17.
for a distance of 843.47 ft. to a point on the centerline
of Gulf Boulevard; thence N 420 13' 31" E along said
centerline, for a distance of 1983.25 ft. to a Point of
Curvature; thence Northeasterly along said centerline. for
a distance of 825.03 ft. along the arc of a curve concave
Northwesterly, through a central angle of 240 45" 04",
having a radius of 1909.86 ft., a chord bearing of
N 290 51' 00" E, 818.63 ft. to a Point on Curve with the
centerline of the Sand Key Jetty. a radial to said point
from the preceding curve being S 720 31' 33" E and from
the proceeding curve being N 680 25' 57" E; thence
