, . FOR AND IN CONSIDERA TION of the sum of One Dollar ($1. 00) cash
in hand paid to it, the receipt of which is hereby acknowledged, and the bene-
fits to be derived therefrom, McBENN CONSTRUCTION COMPANY, INC., a
Florida corporation, does hereby grant and convey to the CITY OF CLEARWATER,
FLORIDA, an easement over, under and across the following described land,
lying and being situate in the County of Pinellas, State of Florida, to wit:
The North 5 feet of Lot 3, DOWNING SUBDIVISION, FIRST ADDITION,
according to map or plat thereof as recorded in Plat Book 62, Page 37,
Public Records of Pinellas County, Florida.
This easement being for sidewalk installation and maintenance.
AND
The South 10 feet of Lot 3, DOWNING SUBDIVISION, FIRST ADDITION,
according to map or plat thereof as recorded in Plat Book 62, Page 37,
Public Records of Pinellas County, Florida.
This easement being for utilities and drainage installation and maintenance.
The CITY OF CLEARWATER, FLORIDA, shall have the right to enter
upon the above described premises and to construct, install and maintain
thereon any sidewalks, utility and drainage lines and to inspect and alter such
sidewalks, utility and drainage lines from time to time.
IN WITNESS WHEREOF, the party hereto has caused these presents
to be duly executed by its proper officers thereunto authorized and its seal to
be hereunto affixed, this 25th day of September , 1972.
