FOR AND IN CONSIDERATION of the sum of One Dollar ($1.00) cash in hand paid to them, the
receipt of which is hereby acknowledged, together with other good and valuable consideration as provided
herein, and the benefits to be derived therefrorn,
Wallace Wade and Earnestine U. Wade, husband & wife,
joined by James Lee Wade and Sandra Elaine Thomas
1007 North Betty Lane, Clearwater, Florida 33755-3302
hereby grants and conveys to the CITY OF CLEARWATER, FLORIDA, a municipal corporation, ingress,
egress and easement over and across the following described lands, lying and being situate in the County
of Pinellas, State of Florida, to wit:
The Ea~t 20 feet of the We~t 200 feet of PINE BROOK UNIT NO.2, Block E, Lot 4, as
recorded in Plat Book 23, Page 71, Public Records of Pinellas County, Florida.
The easement rights hereby granted are for construction purposes of the City of Clearwater,
Florida. The rights granted herein are temporary and will expire automatically one hundred eighty (180)
days following commencement of construction of the Palmetto Street Sediment Sump, City of Clearwater
Public Works Project No. 02-0031-EN, or upon the completion of such construction project, whichever shall
occur sooner, unless extended by written agreement of the parties hereto.
In consideration of the rights granted herein, Grantee, its employees, contractors, agents or
designees agree that all persons entering upon Grantor's property by virtue of the rights herein granted
shall do so at their own risk. Grantor accepts no liability whatsoever for any claims for injury or damages in
connection with this grant of temporary easement.
Restoration of the easement premises to equal or better condition as existed prior to
commencement of project activities will be completed by Grantee, at Grantee expense, not later than
project completion.
