the receipt of which is hereby acknowledged, and the benefits to be derived therefrom,

does hereby grant and convey to the CITY OF CLEARWATER, FLORIDA, a Florida
Municipal Corporation, an easement over, under and across the following described land
lying and being situate in the County of Pine lias, State of Florida, to wit:
A DRAINAGE. UTILITIES AND SIDEWALK EASEMENT OVER AND
ACROSS THE FOLLOWING DESCRIBED PARCEL:
The North Nine Feet (9') of Lots 26, 27, 28 and 29, LESS the North Four Feet
(4') of Lots 26 and 27, and the East Thirteen Feet (13') of Lot 29, all lying in an
un-numbered block of PALM PARK ADDITION TO CLEARWATER, as
recorded in Plat Book 4, Page 86, Public Records of HilIsborough County,
Florida, of which Pinellas County was formerly a part.

This easement is for drainage, utility and sidewalk installation and maintenance,
The CITY OF CLEARWATER, FLORIDA, shall have the right to enter upon the
above-described premises and to construct, install and maintain thereon any drainage,
utility and sidewalk facilities, and to inspect and alter such drainage, utility and sidewalk
facilities from time to time,
The CITY OF CLEARWATER, FLORIDA covenants and agrees with Grantor that it
shall maintain reasonable access to Grantor's facilities at all times during the exercise of
rights granted herein, and that it shall promptly restore the easement premises upon
completion of any project undertaken in the exercise of these rights,

1. That said corporation is the owner oflegal and equitable title to the following described
property in Pinellas County, Florida, to wit:
PALM PARK ADDITION TO CLEARWATER, Lots 26, 27, 28 and 29, as
recorded in Plat Book 4, Page 86, Public Records of HiIlsborough County,
Florida, of which Pinellas County was formerly a part.
2. That said property is now in the possession of the record owner.
3. That there has been no labor performed or materials furnished on said property for which there
are unpaid bills for labor or materials against said property, other than those that will be timely
paid during the normal course of business, and: NO OTHERS.
4. That there are no liens or encumbrances of any nature affecting the title of the property
hereinabove described, except:
5. That certain mortgage and other instruments of security given in favor of First National Bank
of Florida, as recorded in Official Records Book 11250, Pages 896 - 903, and Pages 905 -
910, Public Records of Pin ell as County, Florida,
6 That it is hereby warranted that no notice has been received for any public hearing regarding
assessments for improvements by any government, and it is hereby warranted that there are no
unpaid assessments against the above described property for improvements thereto by any
government, whether or not said assessments appear of record,
7. That there are no outstanding sewer service charges or assessments payable to any
government.
