BETWEEN SUNFISH BAY CONDO ASSOCIATION, INC, of the County of Pinellas and
State of Florida, party of the first part, and CITY OF CLEARWATER, a political
subdivision of the State of Florida, party of the second part,
FOR AND IN CONSIDERATION of the sum of One Dollar ($1,00) cash in hand
paid to them, the receipt of which is hereby acknowledged, and the benefits
to be derived therefrom,
SUNFISH BAY CONDO. ASSOCIATION, INC.
does hereby grant and convey to the CITY OF CLEARWATER, FLORIDA, the following
easement over, under and across the following described land, lying and being
situate in the County of Pinel las, State of Florida, to-wit:
A ten (10') foot water main easement lying 51 each side of the existing
6" or larger water mains up to and including all hydrants and meters,
except where such mains and related water facilities may lie under
structures;
All of the above easement lying within the following described tract:
THAT PARCEL OF LAND LYING SOUTHERLY OF THE NORTH BOUNDARY OF SUNFISH
BAY CONDOMINIUM 4 AS RECORDED IN CONDOMINIUM PLAT BOOK 26, PAGES 14
AND 15 AND ALSO SOUTHERLY OF THE NORTH BOUNDARY OF SUNFISH BAY CONDO-
MINIUM 3 AS RECORDED IN CONDOMINIUM PLAT BOOK 28, PAGES 90 AND 91; AND
LYING NORTHERLY OF THE SOUTHERLY BOUNDARY OF SUNFISH BAY CONDOMINIUM 5
AS RECORDED IN CONDOMINIUM PLAT BOOK 31, PAGES 34 AND 35 ALL IN THE
PUBLIC RECORDS OF PINELLAS COUNTY, FLORIDA; AND EASTERLY OF THE EASTERLY
RIGHT OF WAY LINE OF BAY SHORE BOULEVARD; AND WESTERLY OF OLD TAMPA BAY,
ALL LYING IN SECTIONS 9 AND 10, TOWNSHIP 29 SOUTH, RANGE 16 EAST, PINELLAS
COUNTY, FLORIDA.
The easement above is granted for the maintenance, repair or replacement of
water mains and related facilities,
The CITY OF CLEARWATER, FLORIDA, shall have the right and be obligated to
enter upon the above-described premises an? to construct, install and maintain
thereon any water line and to inspect and alter such water line from time to
time, all at the City's expense,
