AGREEMENT
THIS AGREEMENT, made and entered into this 18th
day of
February
, 1969, by and between DAVID BILGORE & COMPANY,
INCORPORA TED, a Florida corporation, hereinafter referred to as "Owner ",
and tlECITY OF CLEARWATER, FLORIDA, a municipal corporation,
hereinafter referred to as "City";
WITNESSETH
WHEREAS, the City of Clearwater requires a certain easement for
the installation and maintenance of sanitary sewer lines, and said Owner
is willing to grant and convey said easement to the City under certain
conditions;
NOW. THEREFORE, in consideration of the premises and other
good and valuable considerations, it is agreed as follows:
1. The Owner agrees to grant and convey unto the City of Clearwater,
Florida, a municipal corporation, the following:
A sanitary sewer easement over the West 15 feet and
the North 15 feet of tJ\.EtVl_eff440 feet of that part of the
SW-l/4 of NE-l/4/gt S~ction 9, Township 29 South,
Range 16 East, lying South of Tampa and Gulf Coast
Railroad,
at and for the sum of Two Thousand Five Hundred Dollars ($2,500. 00),
which Sum shall also cover the use of the property while jack and boring
two portions of sewer, together with disruption of the plant while moving
fuel tanks.
2. This contract shall be binding on the heirs, successors and
as signs of the parties hereto.
