as Owner, and Grantor, to the STATE OF FLORIDA, acting by and through its component
agency, the State Department of Transportation, as Grantee.
HITNESSETH: vJhereas, the Grantee propos~s to construct a portion of State
Road 55 , designated as Section 15150 Job 2512 , ~-Jhich proposed constru-
ction l-lHl use the entire permanent right of way designed for said road, and said
construction will not, at all points, conform to existing grades and elevations ,of
the abutting private properties, and T'fuereas, it being desirable that said abutting
private lands conform, tie in and harmonize lITith such construction by clearing,
sloping or grading, including cutting or filling of the abutting private property
adjacent to said right of Hay, and provision having been made in Grantee's constru-
ction plans for such grading, sloping, clearing, cutting and filling to be performed
by the Grantee without expense to the abutting private O\.mers, if authorized to do
so, and the nature and extent of such sloping or grading having been outlined to
the undersigned owner,
NOH, THEREFORE, the undersigned Ol-mer, in consideration of the benefits
and the premises accruing or to accrue by reason of the construction or inlprove-
ment of said Road and the sloping or grading to conform Ovmer's frontage to the
grade of the construction, does hereby grant unto the Grantee authority and license
to enter upon the abutting lands of ~.mer and to clear, slope and grade by cutting
or filling ~vithin the limits hereinafter mentioned, and subject to the conditions
hereinafter set fcrth, the lands of Owners being described as follows:
The South 50 feet of SW 1/4 of SW 1/4 of section fJ, Tmmship 29 South,
Range 16 East;
THIS EASillmNT is granted upon the folloHing conditions, viz: (a) the
sloping or grading upon the above land shall not extend more than 6 feet beyond
the permanent right of way for said Road
(b) all gradin8 or sloping shall conform to all existing structural improvements
within the limits designated, and all'l-!Ork lvill be performed in such manner that
existing structural improvements will not be damaged; (c) all ri.ghts of Grantee
hereunder shall cease upon completion of contract for construction of said portion
of State Road.
