E A S E MEN T
FOR AND IN CONSIDERATION of the SUM of One Dollar (Sl.OO) cash in
hand paid to her, the receipt of which is hereby acknowledged, and
the benefits to be derived therefrom, and for the additional considera-
tions that if the present owner should have a legitimate offer to sell
said Lots 2 and 3 listed below, but said sale depended on the cancellation
of this easement by the City, then the City will remove the pipe and
cancel the easement on a 30 day written notice from the present owner to
do so; and furthermore, if the present owner or any future owner of said
Lots 2 and 3 wishes to construct any building over all or any part of
said easement (zoning laws permitting) then the City will remove the
pipe and cancel the easement on 30 days notice.
NELLIE SCHMIDT, a widow,
does hereby grant and convey to the CITY OF CLEARWATER, FLORIDA, an
easement over, under and across the following described land, lying
and being situate in the County of Pinellas, State of Florida, to wit:
The East two (2) feet of Lots 2 and 3, Block 3, Revised Map
of Clearwater Beach, according to map or plat thereof as
recorded in Plat Book 11, page 5 of the Public Records of
Pinellas County, Florida.
This easement being for lda.ter meln installation and maintenance only.
The CITY OF CLEAW;,vATER, FLORIDA, shall have the ri [ht to enter upon
the above described Dremises and to construct, install and maintain
thereon a \.vater main' and to inspect and al ter such water main from
