The Continental Towers Condominium Association, Inc., warrant that it has
the power and authority to grant an easement pursuant to it's Articles of
Condominium, and it's individual members, and thereby grants unto the City
of Clearwater, County of Pinellas, State of Florida, the right of
ingress-egress, and the right to use, for the purpose of public use in
general, a p~rmanent, nonexclusive easement over and through that portion
of the following described real property which lies seaward of a line drawn
parallel to, and lying seaward of, the existing seawall a distance of 50
feet:

Lots 12, 13, 14, and 15, and the riparian rights thereof, in
Block C, of Bayside Subdivision 15 as recorded in Plat Book 38, Pages 38,
and 39 of the Public Records of Pinellas County, State of Florida.
J.'he Grantor also gives to the City of Clearwater a perpetual and
~ponexclusive right to deposit beach quality sand fill upon that portion of
~eal property which lies seaward of the existing seawall, and the right of
'-~ ~ ,jngress-egress and the right to go upon and over said property seaward of
~~ ~ ~the seawall, for the purpose of construction and/or maintenance of a
Z ;j ><: ~p'rotective berm and beach appurtenant thereto. In no event shall the
~DOi~rantor be obliged to spend any of it's own funds to preserve said berm and
