, between FLORIDA POWER CORPORATION, a corporation organized and exist-
ing under the laws of the State of Florida, Party of the First Part, GRANTOR
herein, and the CITY OF CLEARWATER, a municipal corporation organized and
existing under the laws of the State of Florida, Party of the Second Part,
GRANTEE herein.
WITNESSETH, That the GRANTOR, for and in consideration of the sum
of ONE DOLLAR ($1.00) AND OTHER VALUABLE CONSIDERATION, the receipt whereof is
hereby acknowledged, does hereby grant and convey to the GRANTEE, its successors
and assigns, (1) an easement and right-of-way for access road purposes, and
(2) full authority to enter upon, construct, and maintain a road over, upon
and across the following-described tract of land situate and being in Pinellas
County, Florida, to wit:
From the Southwest corner of the NEt of
the SEt of Section 7, Township 29 South,
Range 16 East; run North 000 48' 50" East,
along the West boundary line of said NEt
of the SEt, 172.02 feet for the Point of
Beginning; run thence South 890 18' 39"
East to the Easterly right-of-way line of
GRANTOR'S existing Higgins-Disston l20KV
and Northeast-Curlew 240KV steel tower
electric transmission lines.

A 50-foot wide Access Easement Area which lies
on each side of the following-described center
The GRANTEE, by the acceptance hereof, hereby agrees for itself and
its successors and assigns, that (1) the grade of said access road shall not be
in excess of 2 feet above present ground level, (2) GRANTEE'S equipment used in
the construction of said access road shall not exceed 32 feet in height or have
a boom exceeding 32 feet in height, (3) said access road shall be constructed
in such a manner as to allow perpendicular crossing thereof by GRANTOR'S vehicles
traveling along its right-of-way, (4) the Access Easement Area shall not be used
for parking or storage of any kind, (5) it shall, at its sole risk and expense,
exercise the rights and privileges herein granted, and (6) shall not increase
the GRANTOR'S liability for claims, damages, actions, causes of action from

personal injury or property damage arising or growing out of the use of the
Access Easement Area or exercise of the rights and privileges thereon and
thereto by the GRANTEE, its agents, contractors, employees, licensees,
representatives or type thereof.
TO HAVE AND TO HOLD the said easement or right-of-way unto the
GRANTEE, its successors and assigns, for the purposes aforesaid.
IN WITNESS WHEREOF, the said GRANTOR has caused these presents to
